CITY OF NORTH OLMSTED <br />ORDINANCE NO. 81-104 <br />BY : MRS. ?'ETRI GAC <br />AN ORDINANCE REQUIRING THE CLEVELAND F.LECTRIC <br />ILLUMINATING COMPANY TO PROMPTLY IDENTIFY AND <br />REMOVE IMMEDIATELY, ALL ELEC'TRICAL CAPACITORS <br />NOW LOCATED IN THE CITY OF NORTH OLMSTED WHICH <br />ARE CONSTITUTING A HAZARD TO THE GENERAL PUBLIC, <br />AND DECLARING AN EMFRGENCY, AS AMENDED. <br />?IHEREAS, it has been determined that the Cleveland Electric <br />Illuminating Company has installed on its transmission facilities <br />located within the City of North Olmsted certain electrical <br />capacitors which contain polycholorinated biphenyls (P.C.B.), and <br />WHEREAS, it has been determined by the Environmental Pro- <br />tection Agency that P.C.B. constitutes a potential threat to the <br />health and well being of the public, and <br />WHEREAS, it has been made known to the Council of the City <br />of North Olmsted that certain electrical capacitors in other <br />sections of Ctryahoga County have become defective, have leaked <br />or exploded, and created a real and present danger of persons <br />coming in contact with the P.C.B. contained therein, and <br />WHERFAS, it has been determined by the Council of the City <br />of North Olmsted that there are several such electrical capacitors <br />situated on the public ways in the City and which constitute a <br />real and present danger to the well being of the City of North Olmsted. <br />NOW, THF.REFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLPTSTED, COUNTY OF CUYAEIOGA AND STATE OF OHIO: <br />SECTION l: That the Cleveland Electric Illuminating Comtiany <br />take immediate steps to identify the locations of all electrical <br />capacitors containing P.C.B. located in the City by marking the <br />poles on which said capacitors are situated with easily located <br />and readily identifiable markings as required by U.S.E.P.A. <br />approved instructions directing the public what to do in the event <br />of a leak or accident. That instructions be posted ten (10) to <br />twelve (12) feet above ground level on all the poles containing <br />P.C.B. capacitors, and further that the Cleveland F.lectric Illumin- <br />ating Company remove the said hazardous electrical capacitors and <br />replace the same immediately whicli hazardous capacitors shall be <br />identified by the Director of Public Safety. <br />SECTION 2: That this Council further directs the Director of <br />Public S--af_e_ty to comnlete said determination and to submit to the <br />Clerk of North Olmsted City Council, within sixty (60) days of <br />adoption, a written report of his findings which shall include but <br />shall not be limited to: <br />(a) The location of said poles within the City of North <br />Olmsted. <br />(b) The physical condition of said poles.
