1 <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 81-90 <br />BY: <br />JAMES BOEHMER <br />AN ORDINANCE AUTHORIZING THE BUILDING COMMISSIONER <br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF THE <br />DETACHED STOR.AGE SHED LOCATED ON PERMANENT PARCEL <br />NUMBER 231-19-5 AT 3691 COLUMBIA ROAD, NORTH OLMSTED, <br />(OLD MILLER GREENHOUSE), AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the provisions of Ordinance No. 1331.01 <br />to 1331.99 of the Codified Ordinances of the City of North Olmsted, <br />the Building Commissioner has determined that the detached storage <br />shed located on Permanent Parcel Number 231-19-5 at 3691 Columbia <br />Road, North Olmsted, (Old Miller Greenhouse), the record title <br />holder being R. McKay, 7515 Company, is unsafe, dangerous to human <br />life and hazardous to the safety, health, and public welfare of <br />the citizens of the City of North Olmsted, and <br />WHEREAS, notice to repair, remove, or demolish said buildin.g <br />was served by registered letter on said record title holder on <br />Ap.ril 3, 1981, ordering said title holder to repair, remove, or <br />demolish said building and to commence such repair, removal, or <br />demolition within sixty (60) days of receipt of said notice, and <br />WHEREAS, said record title holder, R. McKay, 7515 Company, <br />failed to reverse the Building Commissioner's order and has also <br />failed to further appeal the decision of the Zoning Board of Appeals <br />to a higher tribunal of competent jurisdiction and this time has <br />failed to comply with the order of the Building Commissioner. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SEGTION 1: That Council deems it necessary to proceed with <br />the demolition and removal of the detached storage shed at <br />3691 Columbla Road, North Olmsted, Ohio, also known as Permanent <br />Parcel Number 231-19-5, owned by R. McKay, 7515 Company, whose <br />mailing address is 7515 Pearl Road, Middleburg Heights, Ohio, <br />by reason of the fact that said dwelling has been determined to <br />be dangerous to human life and a hazard to the public safety, <br />health and welfare of the citizens of the City of North Olmsted, <br />Ohio, and that the cost of said demolition and removal be paid <br />from the General Fund of the City of North Olmsted and charged to <br />the owner(s) as a special assessment or lien on such parcel of land <br />and assessed and collected in the manner of other assessments as <br />provided by law. <br />SECTION 2: That the Clerk of Council be and she is hereby <br />directe to orward a copy of this Ordinance to R. McKay, 7515 <br />Company, 7515 Pearl Road, Middleburg Heights, Ohio 44130.
