s <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 81- 89 <br />BY: JAMES BOEHMER <br />AN ORDINANCE AUTHORIZING THE BUILDING COMMISSIONER <br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF THE <br />FRAME DWELLING ON PERMANENT PARCEL NUMBER 234-12-13 <br />AT 6620 BARTON ROAD, IN THE CITY OF NORTH OLMSTED, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the provisions of Ordinance No. 1331.01 <br />to 1331.99 of the Codified Ordinances of the City of North Olmsted, <br />the Building Commissioner has determined that the abandoned dwell- <br />ing known as Permanent Parcel Number 234-12-13 located at 6620 <br />Barton Road, North Olmsted, Ohio, the record title holder being <br />A4arguerite Southard, is unsafe, dangerous to human life and <br />hazardous to the safety, health, and public welfare of the citizens <br />of the City of North Olmsted, and <br />WHEREAS, notice to repair, remove, or demolish said build- <br />ing was hand-del:ivered by Inspector Bill MacKenzie to James <br />Southard, 25766 Lorain Road, North Olmsted, Ohio, on March 27, <br />1981, ordering said title holder to repair, remove, or demolish <br />said building and to commence such repair, removal, or demolition <br />within sixty (60) days of receipt of said notice, and <br />WHEREAS, said record title holder, Marguerite Southard <br />failed to reverse the Building Commissioner's order and also <br />failed to further appeal the decision of the Zoning Board of <br />Appeals to a higher tribunal of competent jurisdiction and this <br />time has failed to comply with the order of the Building Commissioner. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Council deems it necessary to proceed <br />with the emolitlon and removal of the unsafe dwelling at 6620 <br />Barton Road, North Olmsted, Ohio, also known as Permanent Parcel <br />Number 234-12-13, owned by Marguerite Southard, whose mailing <br />address is in care of James Southard, 25766 Lorain Road, North <br />Olmsted, Ohio 44070, by reason of the fact that said dwelling <br />has been determined to be dangerous to human life and a hazard to <br />the public safety, health and welfare of the citizens of the City <br />of North Olmsted, Ohio, and that the cost of said demolition and <br />removal be paid from the General Fund of the City of North Olmsted <br />and charged to the owner(s) as a special assessment or lien on <br />such parcel of land and assessed and collected in the manner or <br />other assessments as provided by law. <br />SECTION 2: That the Clerk of Council be and she is hereby <br />directe to orward a copy of this Ordinance to Marguerite Southard <br />in care of James Southard, 25766 Lorain Road, North Olmsted, Ohio <br />44070.
