/ <br />w <br />/ <br />C•ITY OF NORTH OLMSTED <br />ORDINANCE N0. 81- 81 <br />BY: JAMES BOEHMER <br />AN ORDINANCE ESTABLISHING A NEW POSITION IN THE <br />DEPARTMENT OF LAW TO BE KNOWN AS "ASSISTANT DIRECTOR <br />OF LAW (ASSISTANT PROSECUTOR)",`AND DECLARING AN <br />EMERGENCY, AS AMENDED. <br />WHEREAS, in the past several years with the expansion af <br />population of the City of North Olmsted, and the increase in the <br />business population, the need for prosecutorial services has <br />increased greatly, and <br />WHEREAS, presently there is a single prosecutor to handle <br />all of the criminal prosecutions in the City of North Olmsted, and <br />WHEREAS, it has become impractical to require one person <br />to handle, not only prosecutions emanating from the Police <br />Department, but also from the Building Department, Engineering <br />Department, and the Service Department, and <br />WHEREAS, it is the desire of this Council to establish a <br />new position for the basic purpose of assisting in prosecutions <br />other than police prosecutions and at the same time to have a <br />back-up for the present prosecutor. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That there is hereby established a new position <br />in the Law Department to be designated as "Assistant Director of <br />Law (Assistant Prosecutor)". The annual salary for said nosition <br />shall be Two Thousand Five Hundred Dollars ($2,500.00), and in <br />addition thereto, said Assistant Prosecutor shall receive additional <br />compensation in the amount of Twenty Five an.d no/100 Dollars <br />(_$25.00) for each "not guilty" plea he attends to on behalf of <br />the City. <br />SECTION 2: That said Assistant Director of Law (Assistant <br />Prosecutor s all have as his main responsibility the prosecution <br />of non-police cases, namely, emanating from the Building Department, <br />the Engineering Department, and Service Department, together with <br />any and all license violations. Said Assistant Prosecutor shall, <br />however, act as a back-up for the Prosecutor in the Prosecutor's <br />absence and shall be compensated as specified in Section I hereof. <br />SECTION 3: That this Ordinance is hereby declared to be <br />an emergency measure immediately necessary for the preservation of <br />the public health, safety, and welfare, and for the further reason <br />that it is immediately necessary to establish continuity in the <br />services of the Prosecutor's Office, and further provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, <br />i.t shall take effect and be in force immediately upon its passage <br />and approval by the Mayor.
