WOERPEL <br />AN ORDINANCE ESTABLISHING A NEW CHAPTER 753 <br />ENTITLED "DRUG PARAPHERNALIA; PdAINTENANCE OR <br />OPER.ATION OF A PLACE OF BUSINESS; EXCLUSION <br />OF T7INORS; REVOCATION OR DENIAL OF LICENSE" <br />OF THE BUSINESS REeULATION CODE OF THE CODIFIED <br />ORDINANCES OF THE CITY OF NORTH OLMSTED, AND <br />DECLARING AN EMERGENCY, AS AMENDFD. <br />WHEREAS, the Council of the City of North Olmsted has <br />determined that the use of drugs by minors is rising at an alarming <br />rate, and that the sale and display of drug paraphernalia encourages <br />and fosters such abuse, and <br />WHEREAS, it is the desire of this Council to exclude minors <br />from that portion of any place of business that sells drug paraphernalia, <br />and <br />WHEREAS, it is the desire of this Council to establish a <br />licensing ordinance whereby the sale of drug paraphernalia is controlled <br />to such an extent that the adverse affect that the sale and display <br />of drug paraphernalia will have on minors will be minimal. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLNiSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That there is hereby established in the Business <br />Regulation Co e a new chapter known as Chapter 753 entitled "Drug <br />ParapheTnalia;Maintenance or Operation of a Place of Business; <br />Exclusion of Minors; Revocation or 1lenial of license", which new <br />section shall read as follows: <br />753.01 SEPARATE ENCLOSED ROOM <br />Except as authorized by law, no person shall maintain <br />or operate any place of business in which drug para- <br />phernalia is kept, displayed or offered in any manner, <br />sold, furnished, transferred or given away unless such <br />drug paraphernalia are completely and wholly kept, <br />displayed or offered within a separate room or enclosure <br />to which persons under the age of 18 not accompanied <br />by a parent or legal guardian are excluded. Each <br />entrance to such a room or enclosure shall be signposted <br />in reasonably visible and legible words to the effect <br />that drug paraphernalia are kept, displayed or offered <br />in such room or enclosure and that minors, unless <br />accompanied by a parent or legal guardian are excluded. <br />753.02 EXCLUSION OF MINORS BY ESTABLISHMENT <br />Except as authorized by law, no owner, manager, <br />proprietor or other person in charge of any room or <br />enclosure, within any place of business, in which drug <br />paraphernalia is kept, displayed or offered in any <br />manner, sold furnished, transferred or given away shall <br />permit or allow any person under the age of 18 years to <br />enter, be in, remain in or visit such room or enclosure <br />unless such minor person is accompanied by one of his <br />or her parents or by his or her legal guardian.
