LOGAN <br />AN ORDINANCE RATIFYING AND CONFIRMING THE ACTION <br />OF THE GREATER CLEVELAND REGIONAL TRANSIT AUTHORITY <br />BOARD OF TRUSTEES IN EXTENDING THE OPERATING AGREE- <br />MENT BETj1iEEN THE GREATER CLEVELAND REGIONAL TRANSIT <br />AUTHORITY AND THE CITY OF NORTH OLMSTED UNTIL <br />FURTHER ACTION OF THF BOARD, AND DECLARING AN <br />EMERGENCY, AS AMENDED. <br />WHEREAS, the City of North Olmsted has sought through the Court <br />System to retain all power and control over their public transportation <br />system, and <br />WHEREAS, the City of North Olmsted heretofore conducted transport- <br />ation services in cooperation with the Greater Cleveland Regional <br />Transit Authoritv by virtue of an Onerating A,greement, and <br />WHEREAS, the Operating Agreement has continued to the present date <br />by virtue of mutual agreements and, as of late, injunctions issued by <br />the Court of Common Pleas and the Court of Appeals of the Eighth <br />Apnellate District, and <br />WHEREAS, the Mayor of the City of North Olmsted, Robert W. <br />Swietyniowski, anpeared at a Board of Trustees' meeting on Tuesday, <br />May 19, 1981, wherein the Board agreed to continue the Oneratin,g <br />Agreement and subsidy associated therewith until further?action of the <br />Board, nrovided that the City of North Olmsted agreed with that action, <br />and <br />WHF,REAS, Mayor Robert W. Swietyniowski does believe that it is <br />in the best interest of the City to ratify and confirm the action of the <br />Board of Trustees of the Greater Cleveland Regional Transit Authority. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That this Council does hereby ratify and confirm the <br />action of the-Board of Trustees of the Greater Cleveland Regional Transit <br />Authority in extending the Operating Agreement until further order of <br />the Board, together with any and all rights, duties and obligations <br />associated therewith. Nothing contained herein shall be construed as <br />relinquishing the City's right of apneal in any nroper jurisdiction con- <br />testing the Greater Regional Transit Authority's right to run parallel <br />and competing transportation service within the City of North Olmsted. <br />SECTION 2: That Mayor Robert W. Swietyniowski be and he is hereby <br />authorize an irected to send a communiaue to the Greater Cleveland <br />Renional Transit Authority Board of Trustees indicating that the City <br />Council officially ratifies and confirms the action of the Board of <br />Trustees in continuing the Operatin¢ Agreement. <br />SECTION 3: That this Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the -oreservation of the public <br />health, safety and welfare, and for the further reason that it is <br />immediately necessary to adont this Ordinance so that the subsidy funding
