LOGAN AN ORDINANCE RATIFYING AND CONFIRMING THE ACTION OF THE GREATER CLEVELAND REGIONAL TRANSIT AUTHORITY BOARD OF TRUSTEES IN EXTENDING THE OPERATING AGREE- MENT BETj1iEEN THE GREATER CLEVELAND REGIONAL TRANSIT AUTHORITY AND THE CITY OF NORTH OLMSTED UNTIL FURTHER ACTION OF THF BOARD, AND DECLARING AN EMERGENCY, AS AMENDED. WHEREAS, the City of North Olmsted has sought through the Court System to retain all power and control over their public transportation system, and WHEREAS, the City of North Olmsted heretofore conducted transport- ation services in cooperation with the Greater Cleveland Regional Transit Authoritv by virtue of an Onerating A,greement, and WHEREAS, the Operating Agreement has continued to the present date by virtue of mutual agreements and, as of late, injunctions issued by the Court of Common Pleas and the Court of Appeals of the Eighth Apnellate District, and WHEREAS, the Mayor of the City of North Olmsted, Robert W. Swietyniowski, anpeared at a Board of Trustees' meeting on Tuesday, May 19, 1981, wherein the Board agreed to continue the Oneratin,g Agreement and subsidy associated therewith until further?action of the Board, nrovided that the City of North Olmsted agreed with that action, and WHF,REAS, Mayor Robert W. Swietyniowski does believe that it is in the best interest of the City to ratify and confirm the action of the Board of Trustees of the Greater Cleveland Regional Transit Authority. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: That this Council does hereby ratify and confirm the action of the-Board of Trustees of the Greater Cleveland Regional Transit Authority in extending the Operating Agreement until further order of the Board, together with any and all rights, duties and obligations associated therewith. Nothing contained herein shall be construed as relinquishing the City's right of apneal in any nroper jurisdiction con- testing the Greater Regional Transit Authority's right to run parallel and competing transportation service within the City of North Olmsted. SECTION 2: That Mayor Robert W. Swietyniowski be and he is hereby authorize an irected to send a communiaue to the Greater Cleveland Renional Transit Authority Board of Trustees indicating that the City Council officially ratifies and confirms the action of the Board of Trustees in continuing the Operatin¢ Agreement. SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the -oreservation of the public health, safety and welfare, and for the further reason that it is immediately necessary to adont this Ordinance so that the subsidy funding
