_ .•- <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 81 - 72 <br />BY: <br />DEAN McKAY <br />AN ORDINANCE ACCEPTING AN EASEMENT FOR THE <br />INSTALLATION AND MAINTENANCE OF A WATER MAIN <br />FOR THE PURPOSE OF SUPPLYING WATER SERVICE <br />BY THE CITY OF CLEVELAND TO THE JAMESTOWN VILLAGE <br />APARTMENTS PHASE NUMBER 7, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Jamestown Village Apartments desires to extend <br />water main service to apartment units included in Phase Number 7, <br />and <br />WHEREAS, the City of Cleveland reauires that extensions of <br />water lines shall only be approved if easements are granted to both <br />the City of Cleveland and the City of North Olmsted so that water <br />mains may be constructed and maintained therein, and <br />WHEREAS, this Council deems it in the best interest of the <br />City to accept the easement described herein. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council does hereby accept an easement <br />from the Jamestown Village Apartments for the installation and <br />maintenance of a water main for the purpose of supplying water service <br />by the City of Cleveland into the Jamestown Village Apartments Phase <br />Number 7, a copy of which said easement is attached hereto and made <br />a part hereof as though fully rewritten herein and marked Exhibit "A". <br />SECTION 2: That the Director of Finance is hereby authorized <br />to issue his warrant and pay to Jamestown Village Apartments the <br />sum of One Dollar ($l.OQ) and other valuable consideration for the <br />granting of this easement. <br />SECTION 3: That the Engineering Department of the City of <br />North Olmsted is hereby directed to cause said easement to be recorded <br />in the Office of the Cuyahoga County Recorder's Office. <br />SECTION 4: That the Clerk of <br />to forward a certified copy of this <br />Utilities of the City of Cleveland. <br />this Council is hereby authorized <br />Ordinance to the Director of Public <br />SECTION 5: That this Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety, and welfare, and for the further reason that <br />it is immediately necessary to approve this easement so that construction <br />may commence on this project, and further provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it <br />shall take effect and be in force immediately upon its passage and <br />approval by the Mayor.
