-?. <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. 81- 43 <br />BY: JAMES BOEHMER <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC <br />SERVICE TO ADVERTISE FOR BIDS FOR THE REMOVAL AND <br />DEMOLITION OF THE HEAD WALL AND THE TEN FOOT B0X <br />CULVERT LOCATED IN COLUMBIA ROAD AT BODECKER HILL, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council has been advised by the City Engineer <br />that the existing head wall and box culvert located in Columbia <br />Road at Bodecker Hill is and does constitute a nuisance, and <br />WHEREAS, said Engineer has indicated that the head wall <br />and culvert are in such state of repair that the same could <br />collapse possibly causing injury to pedestrians and/or any other <br />individual who may be in the area of said culvert, and <br />WHEREAS, it is the desire of this Council to demolish <br />said culvert and head wa11 so as to prevent injury to both <br />persons and property, and <br />WHEREAS, it is the desire of this Council to authorize <br />the Director of Public Service to advertise for bids for said <br />demolition. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and <br />he is hereby authorized and directed to advertise for bids with <br />respect to the demolition of the head wall and box culvert which <br />is located in Columbia Road and Bodecker Hill. Said demolition <br />is to be in accordance with plans and specifications now on <br />file in the Office of the Director of Public Service, and that <br />after approval of the Board of Control the Mayor be and he is <br />hereby authorized to enter into an agreement for the purpose of <br />demolishing said head wall and box culvert. <br />SECTION 2: That this Resolution is hereby declared to be <br />an emergency measure immediately necessary for the preservation <br />of the public health, safety and welfare, and for the further <br />reason that it is immediately necessary to protect the lives of <br />individuals and property in the area of the culvert, and further <br />provided it receives the affirmative vote of two-thirds of all <br />members elected to Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />PASSED: <br />ATTEST: <br />? <br />F RENCE CAMPBELL, ERK OF COUNCIL D E LIMPERT, IPRESIDENT OF <br />COUNCIL <br />APPR VED: <br />? `- W • _ _- _: ? <br />ROBERT W.
