<br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. 81- 34 <br />BY <br />JAMES LOGAN <br />A RESOLUTION ACCEPTING FOR RECORDING <br />PURPOSES ONLY, THE DiBENEDETTO SUBDIVISION, <br />AND ALSO ACCEPTING FOR RECORDING PURPOSES <br />ONLY, THE ADDITIONAL RIGHT-OF-WAY SPECIFIED <br />IN SATD SUBDTVISION PLAT, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the DiBenedetto Subdivision was approved by the <br />Planning Commission on March 10, 1981, and referred to Council, and <br />WHEREAS, said subdivision plan consists of the realignment <br />of three (3) parcels, namely, Permanent Parcel Numbers 232-25-54, <br />232-25-05, and 232-25-06, for the purpose of creating two (2) lots, <br />together with the dedicating to public use of certain areas o£ <br />Brookpark Road Extension and Dover Center Road as more fully specified <br />on said subdivision plat, which property is located on the corner of <br />Brookpark Road Extension and Dover Center Roads, and <br />WHEREAS, said plan has been approved by the City Engineer <br />as being in conformance with the resolutions and ordinances of the <br />City of North Olmsted. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That this Council having been advised of the <br />approval o t e Planning Commission of the DiBenedetto Subdivision <br />and also having been advised of the approval of the Planning <br />Commission of the DiBenedetto Subdivision and also having been <br />advised by the City Engineer that it meets with the rec{uirements <br />of the resolutions and ordinances of the City of North Olmsted <br />hereby approves said plat for recording purposes only. <br />SECTION 2: That upon the effective date of this resolution <br />the City Engineer is hereby directed to cause said subdivision <br />plat to be recorded according to law. <br />SECTION 3: That this Resolution is hereby declared to be <br />an emergency measure immediately necessary for the preservation of <br />the public health, safety and welfare, and for the further reason <br />that the dedication of additional right-of-way must be accomplished <br />so as to coordinate the same with the Dover Road project, and further <br />provided it receives the affirmative vote of two-thirds of all <br />members elected to Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />PASSED: ? <br />ATTEST: <br />FL RENCE CAMPBELL, CL K OF COUNCIL <br />First reading: 3 <br />Second reading: <br />Third reading: <br />DE EY PER , R SI,DEN OF <br />CQUNCZL <br />S ,
