? <br />? <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 81-27 <br />BY: <br />JANET SARINGER <br />100^1 <br /> <br />AN ORDINANCE GRANTING THE PARTIAL RELEASE OF <br />WATER LINE EASEMENT GR.ANTED TO THE CITY BY THE <br />ATLANTIC & PACIFTC TEA COMPANY WHICH WAS HERETO- <br />FORE ACCEPTED BY THE CITY BY VIRTUE OF THE PASSAGE <br />OF ORDINANCE N0. 78-98 ADOPTED JULY 183, 1978, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, it has been determined by the City of North Olmsted <br />that the water line easement previously accepted by the City from <br />the Atlantic $ Pacific Tea Company, which was recorded June 5, 1978, <br />and filed for record purposes December 11, 1978, in Volume 14883, <br />Page 853, Cuyahoga County Easement Records, is no longer needed in <br />its entirety for water line purposes, and <br />WHEREAS, it has been determined that a twenty foot by one <br />hundred fifty foot (20' x 150') section of said easement is no longer <br />needed and, so consequently, may be vacated, and <br />WHEREAS, it is the desire of this Council to vacate the <br />herein described portion of water line easement that is no longer <br />needed for water line purposes. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIp: <br />SECTION 1: That this Council does hereby vacate the follow- <br />ing describe partion of the easement granted to the City by the <br />Atlantic & Pacific Tea Company on June S, 1978, which was filed <br />December 11, 1978, in Volume 14884, Page 853, Cuyahoga County <br />Easement Records, which portion to be released is described as <br />follows: <br />Situated in the City of North Olmsted, County of <br />Cuyahoga and State of Ohio and known as being part <br />of Original Dover Township Lot No. 30 and bounded <br />and described as follows: <br />Beginning in the Northwesterly line of Lorain Road, <br />80 feet wide, at its point of intersection with the <br />Easterly line of said Original Lot No. 30 which is <br />also the Easterly line o£ the City of North Olmsted; <br />Thence S. 580 49' 36" W., 23.27 feet along said <br />Noxthwesterly line of Lorain Road to an angle point <br />therein; <br />Thence S. 580 47' ZO" W., 34.58 feet along said <br />Northwesterly line of Lorain Road to a point; <br />Thence N. 00 59' 41" W., 200.29 feet parallel to <br />said Easterly line of Oxiginal Lot No. 30 to the <br />principal place of beginning; <br />l. Thence continuing N. Q° 59' 41" W., 150.00 £eet <br />to a point; <br />2. Thence N. 890 E., 20.00 feet to a point; <br />3. Thence S. 0° 59' 41" E., 150.00 feet to a point; <br />4. Thence S. 890 W., 20.00 £eet to the principal <br />place of beginning according to a survey as <br />revised February 18, 1981 by Gi1es Nelson, Ohio <br />Surveyor No. 4630, be the same more or less but <br />subject to all legal highways.
