<br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 81-23 <br />BY: <br />JAMES LOGAN <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO <br />THE ELECTORS OF THE CITY OF NORTH OLMSTED OF <br />A PROPOSED AMENDMENT TO THE CHARTER OF THE CITY <br />OF NORTH OLMSTED RELATING TO THE REQUIREMENT FOR A <br />RUN-OFF ELECTION IN THE EVENT THAT NO CANDIDATE <br />POR AN ELECTED OFFICE EXCEPT THAT OF COUNCIL AT <br />LARGE RECEIVES A MAJORITY OF VOTES CAST FOR <br />THAT OFFICE, AND DECLARING AN EMERGENCY. <br />WHEREAS, pursuant to the Charter of the City of North Olmsted, <br />and the Constitution of the State of Ohio, this Council has determined <br />to authorize and direct the submission to the electors of the City <br />of North Qlmsted of a proposed Charter amendment, hereinafter set <br />forth in the Primary Election to be held on June 2, 1981, which <br />election is not less than sixty (60) days nor more than one hundred <br />twenty (120) days from the date of the passage of this Ordinance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO, TW0-THIRDS 0F <br />OF COUNCIL CONCURRING: <br />SECTION 1: That this Council hereby authorizes and directs <br />the submission to the electors of the City of North Olmsted at the <br />Primary Election to be held at the usual places of voting in said <br />City on Tuesday, June 2, 1981, the following proposal to amend the <br />Charter of the City of North Olmsted: <br />Proposal That Section 1 of Article IX o£ the Charter be <br />amended to provide for a run-of£ election in the event that no candidate <br />for an elective office, except that of council-at-large, receives a <br />majority of votes casts for that office. Such amended Section 1 of <br />Article IX to read as follows: <br />ARTICLE IX <br />NOMINATIONS AND ELECTIONS <br />SEC. l. MUNICIPAL ELECTIONS. <br />A general election for the choice of elective officers provided <br />for in this Charter shall be held on the first Tuesday after the first <br />Monday in November in odd numbered years. Elections so held shall be <br />known as regular municipal elections. Such other elections shall be <br />held as may be required by law, or provided for in this Charter. <br />In the event that no candidate seeking an elective office at <br />a general election or special election to fill a vacancy receives a <br />majority of votes casts for that of£ice, except for the office of <br />council-at-large, there shall be a run-off election between the two <br />(2) candidates having received the highest number of votes casts for <br />that office. Any run-off election that may be reauired by virtue of <br />this provision, shall be held on the first Tuesday in December next <br />succeeding the general or special election and shall be held and conducted <br />in accordance with the election laws of the State of Ohio. <br />SECTION 2: That i£ such amendment is approved by a majority <br />of the electors voting thereon at such election, it shall become <br />effective from and after the time of its approval by the electors.
