!;ITY OF NORTH OLMSTED ORDINANCE N0. 89 - 105 BY: COUNCILMAN TALLON AN ORDINANCE VACATING A PORTION OF A SANITARY SEWER EASEMENT LOCATED ON PROPERTY NOW OWNED BY ROMP REALTY COMPANY ON THE SOUTHEASTERN CORNER OF LORAIN AND COLUMBIA ROADS AND FURTHER ACCEPTING AN EASEMENT FROM ROMP REALTY COMPANY FOR A RELOCATED SANITARY SEWER. WHEREAS, the Romp Realty Company has constructed additions to buildings on their property. located on the southeastern corner of Lorain and Columbia Roads, and WHEREAS, the additions over or about an easement presently located, and have been constructed within, in which a sanitary sewer is WHEREAS, it is necessary to vacate a portion of the easement and accept a new easement, in order accommodate a proposed relocated sanitary sewer, and WHEREAS, the Romp Realty Company is responsible for all construction costs and expenses for relocation of the sanitary sewer to a new location within the new easement, and further it is liable for any damage caused to the sanitary sewer by virtue of any construction. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SFC:TTON 1: That a portion of the sanitary sewer easement located on property now owned by the Romp Realty Company and shown in red outline on the Assembly plat for the Romp Realty Company dated March 28, 1989 be, and the same is hereby vacated, and further that the City hereby accepts an easement from the Romp Realty Company for a new Sanitary Sewer Easement which is shown in yellow outline on the said Assembly Plat. S_F.c'TTON Z.: That the granting of the new easement, relocating the sanitary sewer line and vacating the portion of the former easement shall be accomplished at the sole cost and expense of the Romp Realty Company. SF(:TTON 3: That the City Engineer be and he is hereby directed to cause an easement vacation and a r~ew easement consistent with this Ordinance be filed with the County Recorder.
