term includes the streets, lanes, alleys, avenues, easements and other <br />public thoroughfares and public property of the City), with the full and <br />necessary privileges for the use of the Streets and Public Grounds in the <br />City for the construction and installation of antennas, coaxial cables, <br />wires, poles, pole connections, wave guides or other conductors, microwave <br />equiment, electronic equipment and other facilities for the reception, <br />transmission, collection, amplification, origination, distribution or <br />redistribution of audio, video or other signals through a coaxial cable <br />system for the development of broadband telecommunication services in <br />accordance with the law. Notwithstanding the foregoing, the term "Cable <br />System" as used in this ordinance does not include any facilities to the <br />extent they are used in the delivery of cable service directly to <br />subscribers by means of radio frequencies, since the provision of cable <br />services by such means does not require a franchise. <br />SECTION 2: Work on Streets and Public Grounds. The Grantee, in the <br />construction, installation, maintenance or operation of the Cable System, <br />shall not endanger or interefere with the lives of persons, shall not <br />interfere with any installations of the City or any public utility serving <br />the City and shall not unnecessarily interrupt or obstruct the use of any <br />Streets and Public Grounds, and, in connection with any such work, shall <br />obtain such permits and approvals as may be required by the ordinances of <br />the City. When any Streets and Public Grounds are entered upon by the <br />Grantee, or facilities removed therefrom by the Grantee, the Grantee shall <br />restore the same to their original condition and shall clear all such <br />places or obstructions or anything that might constitute a nuisance, or <br />prevent such Streets and Public Grounds from being open and in repair, if <br />such obstruction or nuisance was caused by the Grantee. If the Grantee <br />fails to complete such work within a reasonable period of time, the <br />appropriate officer of the City shall in writing notify the Grantee that <br />the City will complete said work if the same is not completed by the <br />Grantee within fifteen days from receipt of said notice. Any work not <br />completed as determined by said officer shall be completed by the City and <br />the actual out-of-pocket cost of such work shall be charged to the Grantee. <br />Upon the doing of such, work, the City shall furnish the Grantee with <br />itemized bills of the actual out-of-pocket cost thereof, which bills shall <br />be paid to the Grantee within thirty (30) days after the receipt thereof. <br />SECTION 3: Applicable Regulations. The Grantee shall establish, <br />construct, operate and maintain the Cable System in strict compliance with <br />all applicable laws, ordinances, rules and regulations. The Grantee shall <br />obtain all necessary permits, licenses and other required authorizations in <br />connection with such establishment, construction, operation and maintenance <br />of the Cable System. The construction, operation and maintenance of the <br />Cable System by the Grantee and all property of the Grantee subject to the <br />provisions of this franchise shall be subject to the exercise of all lawful <br />police powers of the City.
