construct, install and activate such portions of the Cable System as it <br />determines. In the construction, installation, maintenance and operation <br />of the Cable System, the Grantee shall employ such contractors, <br />subcontractors, staff and consultants and obtain and install such equipment <br />from such vendors, as the grantee shall, in its sole discretion, deem <br />appropriate and the Grantee shall be solely and completely responsible for <br />all acts or omissions of any such contractor, subcontractor and vendor in <br />the construction, installation, maintenance or operation of the Cable <br />System. The Grantee shall, upon the written request of the Mayor of the <br />City, furnish to such office a report semi-annually detailing the progress <br />in the construction and installation of the Cable System. The Grantee <br />shall provide cable communications service by means of the Cable System to <br />those areas of the City where, in the judgment of the Grantee, construction <br />and installation of the Cable System is economically feasible. <br />SECTION 6: Operation, Services and Rates of the Cable System. The <br />Grantee shall provide to the residents of the City quality cable <br />communications service through the Cable System. The Grantee shall render <br />efficient service, make repairs promptly, and interrupt service only for <br />good cause and for the shortest time possible. The Grantee shall initially <br />establish the various services that it shall provide to its subscribers in <br />the City and shall also initially establish the rates it will charge for <br />these services, as well as any charges for installation, late charges and <br />any other additional charges. The Grantee, after initially establishing <br />these items, shall provide such information to the Mayor of the City who <br />shall keep such information on file and available to the public. The <br />Grantee may from time to time amend its services, the rates it shall charge <br />therefor, any additional charges, or any combination thereof. The Grantee <br />shall furnish any such amendment, upon written request of the Mayor, to the <br />Office of the Mayor who shall keep such information on file and available <br />to the public. Grantee shall not, as to rate, charges, services, service <br />facilities, rules, regulations, or in any other respect make or grant any <br />undue preference or advantage to any person, nor subject any person to any <br />undue prejudice or disadvantage and the Grantee shall administer any and <br />all rates and charges so as not to give preference to nor discriminate <br />among subscribers of like category or class; provided, however, that the <br />Grantee may establish special temporary reduced rates for periodic <br />promotional offers to attract new subscribers or for subscribers who pay <br />promptly; reasonable policies for deposits, penalties, or denial of service <br />where a particular subscriber has proven a bona fide credit problem; <br />separate service tiers, rates and other charges for coaxial cable service; <br />or separate rates for commercial and non-commercial users or access <br />channels. The Grantee shall have the sole responsibility for the marketing <br />of the services of the Cable System, including but not limited to <br />solicitation of residents for the purchase of those services. The Grantee <br />shall have the sole responsibility for establishing regulations and <br />guidelines for the installation of its services, disconnection of its <br />
