r,,, _ _- ,~ .. <br />. a <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. 89- 64 <br />BY: COUNCILWOMAN BAHAS <br />A RESOLUTION AUTHORIZING THE MAYOR TO <br />NEGOTIATE AND ENTER INTO A LEASE <br />AGREEMENT WITH HORIZONS ACTIVITY <br />CENTER FOR PROPERTY LOCATED AT 26272 <br />BUTTERNUT RIDGE ROAD, WHICH PROPERTY <br />IS TO BE USED IN CONJUNCTION WITH <br />THE HANDICAP PROGRAM BEING DEVELOPED <br />BY HORIZONS ACTIVITY CENTER AND <br />DECLARING AN EMERGENCY <br />WHEREAS, the North Olmsted Kiwanis Club has previously obtained an <br />interest in property which is designated Permanent Parcel No. 235-6-13 and <br />has heretofore been designated as Charles B. Lewis Memorial Park; and <br />WHEREAS, the City of North Olmsted acquired property immediately <br />adjacent and contiguous to said Kiwanis property; and <br />WHEREAS, the property that was obtained by the City of North Olmsted <br />was accomplished through Community Block Grant funds, the application for <br />which provided that the City of North Olmsted would develop the property <br />for handicapped persons; and <br />WHEREAS, through the efforts of Horizons Activity Center, a proposal <br />has been made to have the City of North Olmsted join together with the <br />North Olmsted Kiwanis Chapter in assisting the Horizons Activity Center in <br />developing what has become known as the Special Horizons Early Intervention <br />Center; and <br />WHEREAS, in order to accomplish the aforesaid programs sponsored by <br />Horizons Activity Center, it is necessary for the City of North Olmsted to <br />enter into a lease agreement with Horizons Activity Center for purposes of <br />developing the Early Intervention Center; and <br />WHEREAS, the City has been advised that Horizons Activity Center has <br />placed in motion all of the prerequisites with respect to state licensing <br />for the implementation of the handicapped program as aforesaid; and <br />WHEREAS, it is the desire of this Council in light of the above to have <br />the Mayor negotiate and enter into a lease agreement with the Horizons <br />Activity Center, which lease agreement will include minimally the following <br />provisions: <br />1. The lease term of twenty-five (25) years; <br />2. Property will be used solely and exclusively for programs which are <br />limited to the handicapped; <br />3. Horizons must pay for any and all insurance for the structure on a <br />comprehensive basis together with liability naming the City as an <br />additional insured; <br />
