CITY OF NORTH OLMSTED <br />ORDINANCE N0. 89- 49 <br />BY: THOMAS O'GRADY <br />A RESOLUTION AUTHORIZING THE DIRECTOR OF PUBLIC SERVICE <br />TO ADVERTISE FOR BIDS FOR PHASE II, DEERFIELD PROJECT <br />DRAINAGE, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Deerfield Subdivision has experienced flooding problems <br />for a number of years; and <br />WHEREAS, a portion of the subdivision had installed a hydro-break <br />system which controlled the accumulation of water thereby alleviating <br />basements from being subjected to flooding conditions; and <br />WHEREAS, it is the desire of this Council to enter into a Phase II for <br />the same system, thereby completing the entire subdivision; and <br />WHEREAS, in order to accomplish same, it is necessary to advertise for <br />bids. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Public Service be and he is hereby <br />authorized to advertise for bids for the construction of Phase II, <br />Deerfield Drainage project in accordance with specifications now on file <br />in his office, and that upon approval by the Board of Control, the Mayor is <br />hereby authorized to enter into a contract and execute the same on behalf <br />of the City of North Olmsted. <br />SECTION 2: That this Resolution is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, <br />safety and welfare and for the further reason that it is immediately <br />necessary to take corrective actions in order to insure the health, safety <br />and welfare of the individuals residing in the Deerfield Subdivision, and <br />further, provided it receives the affirmative vote of two-thirds of all <br />members elected to Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />PASSED: <br />ATTEST:~ <br />
