r <br />l <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 89-16 <br />BY: The Mayor and the Entire Council <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELECTORS OF <br />TFiE CITY OF NORTH OLMSTED OF AN AMENDMENT TO SECTION 8 OF <br />ARTICLE VIII OF THE CHARTER OF THE CITY OF NORTH OLMSTED TO <br />AUTHORIZE THIS COUNCIL TO LEVY ANNUALLY FOR A PERIOD OF TEN <br />YEARS, WITHOUT A VOTE OF THE PEOPLE, AN ADDITIONAL TAX AT A <br />RATE NOT EXCEEDING SEVEN-TENTHS OF ONE MILL TO PROVIDE FUNDS <br />FOR MUNICIPAL RECREATIONAL PURPOSES, INCLUDING PAYMENT OF <br />COSTS OF PROVIDING PERMANENT IMPROVEMENTS, CURRENT OPERATING <br />EXPENSES AND ANNUAL DEBT SERVICE REQUIREMENTS ON CERTAIN <br />OBLIGATIONS ISSUED TO PAY COSTS OF PROVIDING AND IMPROVING <br />RECREATIONAL FACILITIES, AND DECLARING AN EMERGENCY. <br />WHEREAS, this Council has determined that additional funds will be <br />needed during the next ten years for municipal recreational purposes, <br />including payment of costs of providing permanent improvements for <br />recreational purposes (including, without limitation, rehabilitating the North <br />Olmsted Recreation Center), current operating expenses for recreational <br />purposes, and annual debt service requirements on obligations issued to pay <br />costs of providing and improving recreational facilities or to refund <br />obligations issued for that purpose; and <br />'WHEREAS, this Council has further determined, accordingly, to submit <br />to the electors of the City of North Olmsted the proposal to amend the City's <br />Ckiarter set forth in Section 1 to authorize this Council to levy annually for <br />a period of ten years, without a vote of the people, an additional tax at a <br />rate not exceeding seven-tenths of one mill to provide funds for those <br />municipal recreational purposes; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, Cuyahoga County, Ohio, two-thirds of all members concurring, that: <br />SECTION 1. Pursuant to Article XVIII, Section 9 of the Ohio <br />Constitution and Article XII of the Charter of the City of North Olmsted, this <br />Council authorizes and directs that the following proposal to amend the <br />Charter of the City of North Olmsted be submitted to the electors of the City <br />of North Olmsted at an election to be held at the usual places of voting in <br />the City on Tuesday, May 2, 1989: <br />That existing Section 8 of Article VIII of the Charter be amended to <br />read as follows: <br />"SECTION 8: LIMITATION ON THE RATE OF TAXATION <br />(a) The aggregate amount of taxes that may be levied by the <br />Council without a vote of the people on taxable property assessed and <br />listed for taxation according to value shall not exceed in any one <br />year the aggregate of the amounts provided for in Paragraphs (b), (c) <br />and (d} of this Section 8; rrc.ridcd tl~.at the tax provided for it <br />Paragraph (d) of this Section 8 may only be levied in the tax years <br />from 1989 through 1998, for collection in the calendar years from <br />1990 through 1999. All such taxes shall be levied by not less than a <br />two-thirds affirmative vote of the members of Council eligible to <br />vote. <br />
