'~ 3. That the COUNTY shall maintain the structural elements of any bridge ~~ ~ (defined as a structure with a span of twenty feet or greater) .~ ~~ located within the limits of the improvement in accordance with the ~~ applicable sections of the Ohio Revised Code. It is understood and ;, agreed that the roadway pavement. curbs. sidewalk. lighting system. traffic control devices and other appurtenances do not comprise the !' structural elements of abridge. ~~ I' ~ 4. That the COUNTY will remove Stearns Road from the County summer ~~ assistance maintenance program. ~i !I E. TRAFFIC i~ ~ That upon completion of said improvement said MUNICIPALITY will thereafter keep said highway open to traffic at all times; and ~~ 1. Place and maintain all traffic control devices conforming to the Ohio Manual of Uniform Traffic Control Devices on the improvement in ~~ compliance with the provisions of Section 4511,11 and related sections of the Ohio Revised Code. 2. The street or highway shall be and hereby is designated a through !' highway as provided in Section 4511.07 (F) Ohio Revised Code. I ~~ 3. The MUNICIPALITY shall prohibit parking within the limits of the '~ roadway constructed under this contract within the corporate limits of the MUNICIPALITY. ~'F. RIGHT-OF-WAY I! ;' 1. That all existing street and public right-of-way within the MUNICIPALITY which is necessary for the aforesaid improvement shall '~ be made available therefor. 2. That the COUNTY will acquire any additional right-of-way which may ~! be required for the construction of this project. ,~ 3. In the event the MUNICIPALITY acquires the additional right-of-way, it shall certify that such additional right-of-way is available prior to the public advertisement for bids for the construction contract. All property rights and/or items required to be certified as available for the improvement should be obtained in accordance with the necessary procedures as required by the funding requirements. , 4. It is understood and agreed that,°"in the event the MUNICIPALITY requests additional items to be included in the improvement pursuant to Section H-1 herein below, the MUNICIPALITY shall pay the entire cost of any additional right-of-way necessitated by the inclusion of such additional items. The phrase "cost of right-of-way" is defined to include but not be limited to appraisals, property rights. residual damages, relocation expenses. title and escrow expenses. and other related items. - 3 -
