CITY OF NORTH OLMSTED <br />ORDINANCE Np. 83) - 135 <br />BY. ? <br />AN ORDINANCE AUTHORIZING AND DIRECTING THE DIRECTOR OF <br />PUBLIC SERVICE TO ADVERTISE FOR THE COhSTRUCTION OF <br />ADVANCED SECONDARY ADDITIONS AND MODIFICATIONS TO THE <br />EXISTING b1ASTEWATER TREATMENT PLANT INCLUDING PHOSPHOROUS <br />REP10VAL, NITRTFICATION, ODOR CONTROL, AND SOLIDS HANDLING <br />FACILITIES AS IN THE PLANS AND SPECIFICATIONS APPROVED BY <br />THE OHIO ENVIRONMENTAL PROTECTTON AGENCY'S PERMIT ISSUED <br />SEPTEMBER 22, 1983, AND KNOWN AS PROJECT N0. C-391665-03, <br />AND DECLARING AN EME:GENCY. <br />WHEREAS, the City of North Olmsted has received a Grant under <br />the provision of the Clean Water Act from the U.S. Environmental <br />Protection Agency for modification and additions to the Wastewater <br />Ireatment Plant, and <br />WHEREAS, it is the desire to fully comply with all provisions <br />of the aforesaid U.S. Environmental Protection Agency Grant, and <br />4JHEREAS, it is the further desire of this Council to determine <br />the cost of said Wastewater Treatment Plant addition as hereinbefore <br />specified by authorizing the Director of Public'Service to advertise <br />for bids. <br />NOW, THEREFORE, 2E IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORiH OLPISTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Director of Pu61ic Service be and he is <br />hereby authorized to advertise for bids on a single bid basis utilizing <br />a Qeneral contractor rather than soliciting sub-trade bids. ihe bids <br />to be solicited shall be in accordance with the specifications which <br />are now on file in the office of Public Service, and that upon approval <br />by the Board of Control, the tlayor is hereby authorized to enter into <br />a contract and execute the same on behalf of the Cit,y of North Olmsted <br />to the lowest and best bidder. <br />SECTION 2: That this ordinance is hereby determined to be an <br />emergency measure immediately necessary for the preservation of the <br />public peace, health, safety and welfare, and for the further reason <br />that it is immediately necessary to commence construction of the <br />Treatment Plant expansion so that E.P.A. Grant requirements are met, <br />and further provided that it receives the affirmative vote of two- <br />thirds of all members elected to Counci'1, it shall take effect and be <br />in force immediately uaon its passage and approval by the Mayor. <br />P A S S E D: 4./ 9-F•3 <br />A'TTEST: <br />b.
