i CITY OF NORTH OLMSTED ORDINANCE N0. 83 - 124 BY: RUSS BIERMAN Ili 4 ,Ya 1 AN ORDINANCE PROVIDING FOR THE ADOPTION OF A NEW SECTION 1173.02(H)2 OF THE ZONING CODE OF THE CITY OF NORTH OLMSTED OF CHAPTER 1173 ENTITLED "GENERAL RETAIL BUSINESS DISTRICT", AS AMFTIMED. WHEREAS, in recent months the City has experienced a great deal of building activity with respect to the placement of canopies over the island pumps in service stations, both with respect to old construction and new construction, and WHEREAS, it is the desire of this Council to establish standards for the construction of canopies relative to existing service stations. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAAOGA, AND STATE OF OHIO: SECTION l: That there is hereby established a new Section 1173.02(H)2 of Chapter 1173 of the Zoning Code entitled "General Retail Business District", which new Section 1173.02(H)2 shall be entitled "Regulations for the Construction of Canopies over Pump Islands at Gasoline Service Stations", which new Section shall read as follows: 1173.02(H)2 Regulations for the Construction of Canopies over Pump Islands at -,Gasoline Service Stations Where a gasoline service station is permitted to be constructed or main- tained, the following regulations shall apply: (a) Existing Service Stations - Service stations existing and operating as of the effective date of this Ordinance shall be permitted to con- struct canopies over the pump islands in front of the main building setback line or the side yard setback line, but the canopy shall not extend more than ten (10) feet beyond the row of pumps nearest a public right-of-way, and in no event shall the canopy extend over an existing right-of-way. Further, in the event a canopy is erected over a planned right-of-way, and it becomes necessary to expand the existing right-of- way, the owner of said canopy shall be required to remove that part of the canopy which would then encroach on the expanded existing right-of- way. The maximum height from grade for this structure shall be 20 feet. No signs or any identification shall be attached to the structure. Lighting fixtures shall be installed on the underside of the roof deck/ceiling only. (b) New Service Stations - Any new service stations not in operation on the effective date of this Ordinance shall be permitted to construct canopies over the pump islands in front of the main building provided that all of the provisions with respect to construction in the front set- back line and sideyard have been met. SECTION 2: That the Clerk of this Council be and she is hereby directed to cause notice of a public hearing hereon to be given pursuant to the provisions of Section 14 of Article IV of the.Charter of the City. SECTION 3: That any ordinance or parts of ordinances inconsistant here- with are hereby repealed. SECTION 4: That after submission of this Ordinance to the Planning Com- mission of the City for its opinion and recommendation, and after Public Hearing as specified in Section 2 hereof, and after its passage, pursuant to the Charter of the City, the Zoning Code of the City of North Olmsted shall be amended as specified in Section 1 hereof.
