<br />under the collective bargaining agreement may be paid to <br />such employees. To the extent re quired by Section 4115.032, <br />Ohio Revised Code, the Company shall comply, and shall <br />require compliance by all contractors or subcontractors <br />working on the Project, with all applicable requirements of <br />Sections 4115.03 through 4115.16, Ohio Revised Code, includ- <br />ing without limitation, obtaining or causing to be obtained <br />from the Ohio Department of Industrial Relations (the <br />"Department") its determination of the prevailing rates of <br />wages to be paid for the class of work called for by the <br />Project. Prior to the issuance of the Project Bonds, the <br />Company shall provide the Issuer with evidence, satisfactory <br />to the Issuer, that it has complied with the foregoing <br />agreement. The Issuer hereby designates and appoints Mary <br />Slama as its Prevailing Wage Coordinator. <br />Section 9. Agreement, Assiq nment, Bond Purchase Aaree <br />ment and Note. In order to evidence and secure the payment <br />of the Bond Service Charges as the same shall become due an8 <br />payable, the Executive and the Fiscal Officer, as appro- <br />priate, are hereby authorized and directed to execute, <br />acknowledge and dgliver, in the name and on behalf of the <br />Issuer, the Agreement, the Assignment and the Bond Purchase <br />Agreement and to endorse the Note to the Bondholders in <br />substantially the forms submitted to the Legislative Author- <br />ity, which instruments are hereby approved, with such <br />changes therein not inconsistent with this Bond Legislation <br />and not substantially adverse to the Issuer as may be per- <br />mitted by the Act and approved by the officers executing or <br />endorsing the same on behalf of the Issuer. The approval of <br />such changes by said,officers, and that such are not sub- stantially adverse to the Issuer, shall be conclusively <br />evidenced by the execution and endorsement of such instru- <br />ments. <br />Section 10. Federal Tax Election by Issuer. The <br />Issuer hereby elects with respect to the Project Bonds, to <br />be within the limitations imposed by the provisions of <br />Section 103 (b) (6) (D) of the Code and the Executive or Fiscal <br />Officer is hereby authorized and directed to perform any and <br />all acts and provide such information as may be required by <br />the Secretary of the Treasury, his delegate or the Internal <br />Revenue Service in order to implement such election, and any <br />and all acts heretofore taken pertaining to such election <br />and relating to such requirements are hereby ratified and <br />confirmed. <br />Section 11. Other pocuments. The Executive, the <br />Fiscal Officer, and the Clerk of the Legislative Authority <br />or other appropriate officers of the Issuer are hereby <br />19
