CITY OF NORTH OLMSTED ORDINANCE N0. 83 - lOl BY: AN ORDINA CE AUTHORIZING THE MAYOR TO ENTER AN AGREEMENT WITH THE CITY OF FAIRVIEW PARK RELATIVE TO THE OWNERSHIP, OPERATION AND MAINTENANCE OF THE PROPOSED SANITARY RELIEF SEWERS RECOMMENDED IN THE NORTH OLMSTED FACILITIES PLAN. WHEREAS, the City of North Olmsted has completed a Step 1 Facilities Plan for wastewater collection and treatment in the North Olmsted Facilities Planning Area, and a Sewer System Evaluation Survey Report, a Step 2 construction plan for the improvement of the North Olmsted Wastewater Treatment Plant and plans for improvements to the sanitary sewer system, and WHEREAS, the aforesaid facilities plan and sewer- system evaluation survey report include the construction of a relief sewer to serve the area of Fairview Park tributary to the North Olmsted Wastewater Treatment Plant; and WHEREAS, the City of North Olmsted and the City of Fairview Park desire a Step 3 grant for the improvements recommended in the Facilities Plan; and WHEREAS, the City of North Olmsted has been designated the lead agency and grantee for all grant applications in the North Olmsted Wastewater Treatment Plant Service Area; and WHEREAS, the regulations of the Environmental Protection Agency require that the grant recipient own and operate the sanitary relief sewers proposed in the Facilities Plan. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: SECTION 1: That the Mayor be and is hereby authorized to enter into the agreement attached hereto and made a part hereof as Exhibit "A" with the City of Fairview Park. SECTION 2: That this ordinance shall not be construed as amending in anyway the existing contract for service between the City of Fairview Park and the City of North Olmsted. SECTION 3: It is found and determined that all formal actions of this Council concerning and relating to the adoption of this ordinance were adopted in an open meeting of this Council and that all deliberations of this Council and any of its committees that resulted in such formal action were in meeting open to the public in compliance with all legal requirements of Section 121.22 of the Ohio Revised Code.
