' ? ... , _, ? ,..?.,_? ...?,..,.. .?.a._ . <br />t ' <br />.` I <br />WHEREAS, the regulations of the Environmental Protection <br />Agency require the grant receipient to own and operate the <br />sanitary relief sewers proposed in the Facilities Plan. <br />NOW, THEREFORE, in consideration of the premises and of the <br />mutual covenants hereinafter set forth and of other good and <br />valuable considerations, the municipalities do hereby promise <br />and agree as follows: <br />SECTION 1: The City of Fairview Park agrees that the City <br />of North Olmsted shall own and operate the sanitary relief sewers <br />proposed in the Facilities Plan and shown on plans prepared by <br />Alex Kanareff and Associates, Consulting Engineers dated June <br />1983. <br />SECTION 2: The City of Fairview Park agrees to fund the <br />non-Federal share of the cost to construct the sanitary relief <br />sewers. <br />SECTION3: The City of Fairview Park agrees to obtain all <br />easements required across private property at its cost. The <br />City of North Olmsted agrees to acquire by eminent domain all <br />easements required within the City of North Olmsted which can <br />not be purchased through negotiation by the City of Fairview <br />Park, at the City of Fairview Park's cost. <br />SECTION 4: The City of North Olmsted agrees to reserve the <br />capacity of the sanitary relief sewers exclusively for flows <br />originating in the City of Fairview Park. <br />SECTION 5: The City of Fairview Park agrees to maintain and <br />to pay the cost of maintaining the sanitary relief sewers <br />including those within the City of North Olmsted which are shown <br />on plans prepared by Alex Kanareff and Associates, Consulting <br />Engineers, dated June 1983. <br />SECTION 6: This agreement shall take effect on the date <br />hereof and shall be for the benefit of, and shall be binding <br />upon, the successors and assigns of the parties hereto. <br />IN WITNESS, WHEREOF, the parties hereto have caused this <br />agreement to be executed by their respective officers thereunto <br />duly authorized as of the day and year first above wr•itten. <br />Attest: CITY OF FAIRVIEW PARK <br />Mayor <br />Attest: , CITY OF NORTH OLMSTED <br />Mayor <br />Approved as to Legal Ford: <br />Michael R.
