CITY OF PJORTH OLMSTED <br />ORDINANCE N0. 83 - 151 <br />BY : 4/,? <br />41 <br />AN ORDINANCE AUTHORIZIPJG THE CITY ENGINEER APdD/OR <br />THE BUILDIPJG COMMISSIONER TO PERh1IT AND ALLOW THE <br />TEMPORARY UISCOPdNECTION OF ROOF DOWNSPOUTS FROM <br />THE MAIiV SEWER AND SPLASH DOWPJ OF ROOF WATER <br />DIRECTLY UPON THE GROUND, AND GRANTING A TEMPORARY <br />SUSPECdSION OF SECTION 917.02 OF THE NORTH OLMSTED <br />CODIFIED ORDINANCES, AND DECLARING AN EMERGENCY. <br />WHEREAS, it has beeen determined that certain roof downspouts are <br />connected to the sanitary sewer system, which is a violation of Section 913.18 <br />of the PJorth Olmsted Codified Ordinances, and <br />WHEREAS, these connections to the sanitary sewer system are causing a <br />serious health and safety problem to certain residents of the City of North <br />Olmsted due to flooding and sewage back-up, and <br />WHEREAS, it is the desire of the Council to cause this flooding situation <br />to be resolved and corrected. <br />PlOW, THEREFORE, BE IT ORDAIPJED BY THE COUPdCIL OF THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That the City Engineer and/or the Building Commissioner be and <br />is hereby authorized to grant permission to the owner of property having roof <br />downspouts connected to the sanitary sewer system to disconnect said downspouts <br />and permit splash down af roof water directly upon the ground, for a period not <br />to exceed thirty (30) calander days from the authorized date of disconnection. <br />SECTIOPd 2: That at the end of the authorized thirty (30) day period, the <br />City Engineer and/or the Building Commissioner will inspect, or cause to be <br />inspected, the property granted permission to disconnect and splash down to <br />determine and verify that the downspouts have been connected to the storm sewer <br />as required by Section 917.02 of the North Olmsted Codified Ordinances. <br />SECTIOhI 3: That, in the event that inspection indicates that certain down- <br />spouts have not been correctly connected to the storm sewer, and after the <br />expiration of the thirty (30) day authorized disconnection and splash down period, <br />the names of the owners then in violation of Section 917.02 of the North Olmsted <br />Codified Ordinances shall be forwarded to the City Prosecutor for appropriate action. <br />SECTIOPd 4: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, <br />and for the further reason it is immediately necessary to prevent sewage backup, <br />flooding and further deterioration of the sanitary sewer system, and further <br />provided it receives the affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />PASSED: S`. 12TSJ <br />RTT T: <br />6. <br />orence E.
