<br />mate the transactions provided for in the Note Documents and this Note <br />Legislation. <br />Section 13. Compliance with Section 121.22 of the Ohio Revised <br />Code. It is found and determined that all formal actions of this Legis- <br />lative Authority concerning and relating to the adoption of this Legis- <br />lation were adopted in an open meeting of this Legislative Authority. <br />and that all deliberations of this Legislative Authority and of any of <br />its committees that resulted in formal action, were in meetings open to <br />the public in compliance with all legal requirements, including Section <br />121.22 of the Ohio Revised Code. <br />Section 14. Federal Tax Election. This Legislative Authority <br />hereby elects to have the limitation on capital expenditures specified <br />in Section 103(b)(6)(D) of the Code applied to the Project Note, and the <br />Executive Officer, the Fiscal Officer or any other duly suthorized <br />officer is hereby authorized and directed to execute and file with the <br />Internal Revenue Service a statement regarding such election, as provid- <br />ed by the rules and regulations of the Internal Revenue Service. <br />Section 15. Designation and Appointment of Prevailing Wage Co- <br />ordinator. The Issuer does hereby designate and appoint Mary Slama as <br />its prevailing wage coordinator for the Pro,ject, pursuant to the re- <br />quirements of Section 4115.071, Ohio Revised Code to perform the duties <br />therein specified. <br />Section 16. Effective Date. This Ordinance is hereby declared to <br />be an emergency measure for the immediate preservation of the public <br />peace, health and safety, and f or further reasons that this Ordinance <br />must be imediately effective to eliminate the hazards to the Issue and <br />its people resulting from lack of Job opportunities. <br />33
