CITY OF NORTH OLMSTED <br />ORDINANCE N0. 83- 35 <br />BY <br />AN ORDINANCE AMENDING SUBSECTION (f) OF SECTION 351.20 <br />OF THE CODIFIED ORDINANCES ENTITLED "HANDICAPPED PARKING". <br />WHEREAS, originally the Council was of the opinion that it <br />would be in the best interest of the City to require those who were <br />not entitled to park in handicapped parking spaces to be required <br />to appear in court rather than to appear before the Waiver Bureau <br />for the purpose of paying a fine for illegal parking, and <br />WHEREAS, this Council has since determined that it would <br />be impractical to prohibit the use of the Waiver Bureau, and so <br />therefore it is the desire of this Council now to treat a violation <br />of the Handicapped Parking Ordinance as any other parking violation. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF 011I0: <br />SECTION l: That Subsection (f) of Section 351.20 entitled <br />"'-Iandicapped-Parking" which now reads : <br />"(f) Any person who violates Subsection (d) hereof <br />shall be guilty of a minor misdemeanor, the fine <br />for which may not be waiverable as provided in <br />Section 351.18 of the Codified Ordinances. Any <br />person charged under Subsection (d) hereof, shall <br />have an absolute defense if they are, in fact, <br />handicapped as defined by Ohio Revised Code <br />Section 4511.69(H)." <br />be and the same is hereby amended and as amended shall read as <br />follows: <br />(f) Any person who violates Subsection (d) hereof <br />shall be guilty of a minor misdemeanor, the fine <br />for which is more specifically set out in Chapter <br />351 of the Traffic Code.
