Aw <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 83 - 48 <br />BY: YVONNE PETRIGAC <br />AN ORDINANCE ESTABLISHING A NEW SECTION 509.09 <br />OF THE CODIFIED ORDINANCES ENTITLED "CREATING <br />A DISTURBANCE-CONSUMPTION OF ALCHOLIC BEVERAGES" <br />OF CHAPTER 509 ENTITLED "DISORDERLY CONDUCT AND <br />PEACE DISTURBANCE", AND DECLARING AN EMERGENCY. <br />WHrREAS, this Council has become aware that in the past <br />on numerous occasions the peace and quiet of the City of North <br />Olmsted has been disturbed by parents and other individuals <br />permitting unruly parties where consumption of alcholic beverages <br />consumed by those not authorized normally to consume alcholic <br />beverages, and <br />WHEREAS, it is the desire of this Council to place upon <br />the property owners or tenants who have right of possession <br />to so control any gatherings that they may have so as to eliminate <br />the disturbance of the peace which comes about by virtue of t11e <br />consumption of alcholic beverages. <br />NQW, THERF:FORE, BE IT ORDAINED BY THE COUNCIL OF TIIE CITY <br />Or NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That there is hereby created a new section <br />of the Codf ed Ordinances which sha.ll be known as Section <br />509.09 entitled "Creating a Disturbance-Consumption of Alcholic <br />Beverages" of Chapter 509 entitled "Disorderly Conduct and <br />Peace Disturbance", which new Section shall read as follows: <br />509.09 CREATING A DISTRUBANCE-CONSUMPTION <br />OF ALCHOLIC BEVERAGES. <br />a. No person being the owner or occupant <br />of any premises located within the city shall <br />knowingly permit two or more persons to remain <br />on said premises, if said persons are consuming <br />intoxicating liquor or beer when said person <br />or persons are under the age of twenty-one <br />(21) years with respect to intoxicating liquor, <br />and under the age of nineteen (19) years with <br />respect to consumption of beer (See, Ohio <br />Revised Code Section 4301.01 for definition <br />of intoxicating liQuor or beer), and at the <br />same time are violating the provisions of <br />Section 509.03 of the Codified Ordinances <br />of the City of North Olmsted (Disorderly <br />Conduct-Intoxication). <br />b. Whoever violates this section shall be <br />guilty of a misdemeanor of the fourth degree, <br />however, any person who violates this Section <br />and persists or refuses to assist in abating <br />the conduct, which is the subject of Subsection <br />(a) hereof, after reasonable warning or a reauest <br />to desist, then that conduct shall be a mis- <br />demeanor of the third degree.
