Wherc a pcnnit <br />is issued for the conncction of a f?re hydrant, the entire cost o( such fire hydrant installation ic> such tnain <br />installed by PURVGYOR shall be paid in advance to PURVEYOR by MUNICIPAL(TY or the party re- <br />questing sucli installation. No tap-in ctiargc shall be asscssed by PURVEYOR for llie privilcge of connec- <br />ting a distribution main to any water main constructed under the provisions of Ihis paragraph 10A2. <br />10.03 No tnain less than twenty inches (20") in diameler, which primarily functions as a irunk main, that <br />is, primarily furnishing water to other distribution mains and not to service connections, shall be installed <br />at the cost of MUNICIPALITY without MUNtCIPALITY'S consent in writing. <br />10_04 No distribulion main or firc hydrant shall be constructed and connccted to the waterworks system <br />unless the following requirements havc bcen satisfied: <br />(a) Prior to construction of the main, preliminary plans shall be furnished (o the Commissioner in <br />duplicate which shall show: <br />(1) the strect and other public ways and places in which such distribulion main is to be installed, with <br />thc location of all monuments or stakes necessary to establish the centerline of such streels or other public <br />ways; <br />(2) the prescnt surface of the street; <br />(3) the establishcd gradc of thc street, (including cases where the grade is establistied, but the strcet or <br />public way has not been graded in accordaiice with the established grade); <br />(4) the proposed size and location of all mains, pipes, valves, hydrants and o(her appurtenances and <br />the location of existing or proposed sanitary sewers. PURVEYOR may requesl modification to said plans <br />and final plans shall be drafted and submitteci incorporating all modifications required by Commissioner. <br />GiKht copies of the final plans shall be furnished to Commissioner in accordance with the provisions of this <br />AGREGMENT. Upon approval of final plans, installation of the main may commence. Six copics of the <br />tinal plans will be retained by the Commissioner in the files of the Division of Water. Two copies o[ the <br />plans shall be returned lo MUNICIPALITY, one oi which shall be retainecl in the files of tlie <br />MUNICIPALITY. <br />(b) PURVEYOR shall have the right to refuse to approve the construction o( a new water main or the <br />extension of an existing water main aitd the right to refuse connection of a new water main or service con- <br />ncction lo the existing water system in any area where sanitary sewers and sewage treatment facilities, or <br />plans for such Cacilities, have not been approved by the local sewer authority and MUNICiPALITY or in <br />any area where the Ohio Gnvironmental Protection Agency has impo5ed•a tap-in ban prohibiting addi- <br />tional connections to the existing sewer syslem serviced by the local sewer authority. In the event that <br />PURVGYOR has approved construction of a water main on the basis of plans t'or sewer facilities, then <br />I'URVEYOR ?nay refuse to approve conncction of such water main until the sewer facilities have been con- <br />structed. <br />(c) When distribution maiiis are to be installed in a street dedicated by the owner lo the public and pro- <br />perly recorded, but not accepled by the MUNICIPALITY, said distribution maiii may nol be constructed <br />until the owner shall grant and record an easemenl for the full lenglh and width of such street to <br />MUNICIPAL,ITY and PURVEYOR, providing for the installation of water mains, service connections <br />and anPurlenances and their maintenance pending acceptance of the strect by MUNICIt'ALITY.
