DAMACE TO SYS'I'EM ANU RELEASb; OH LIABILITY 13.01 MUNICIPALITY agrccs to make no claim against PURVEYOR on account of any brcak or icak in any watcr main, or fire hydrant in any public strcet, highway or eascmcnt which claim ariscs betore PURVEYOR has notice of such leak and before PURVEYOR has had a reasonable period of time to act .- after such notice is received to cure any such condition. 13.02 MUNICIPALITY shall bear the cost of repairing waler mains and service connections that may bc damagcd duc to being embedded wholly or parUy within a sewcr, manhole or catch basin. MUNICIPALITY shall save PURVEYOR harmless from any claim for damagcs caused by a break in any water main, pipe or service connection that results [rom the water main, pipe or service connection being embedded wf?olly or nartly witliin a sewer, manhole or catch basin in violation of regulations of any en- vironmental protection agency. 13.03 Rcpair and maintenance of new valve boxes, hydrants, scrvice connections and their ap- purtenances installed by a conlractor shall be the obligation of MUNICIPALITY for a period of two years after completion, unless the contract for such installation provides for such maintenance to be furnished by the contractor or some other party. 13.04 If any contractor employed by MUNICIPALITY damages any water mains or other water plant faeilities which are the propcrty of PURVEYOR, MUNICIPALITY shall be responsible for the repair of said tacilities or pay PURVEYOR for such damage, upon receipt of bill. - AKT'ICLE 14. MAINTENANCF. OF DISTRIBUTION SYSTEM BY MUNICIPALITY 14.01 In the cvent tiiat MUNICIPALITY desires to undertake the repair and maintenance of all or any part of ilie distribution system Iocaled within its geographic territory, MUNICIPALITY and PURVEYOR may, by muwal agreement, enter into a written agreement supplemental to this AGREEMENT modiCying aFld amending this AGREEMENT with respect to the duties, responsibilities and liabilities related to such maintenance and repair work. Nothing in ihis AGRGEMENT shaU prohibit MUNICIPALITY from becoming a Master Meter Community if MUNICIPALITY and PURVEYOR can reach mutually agreeable Ierms and conditions for such change in status. ARTICLF: 15.
