Dean P1c <br />Af'J ORDINANCE AUTHORIZING THE t1AYOR OF THE CITY OF NORTH OLMSTED TO <br />ENTER INTO AN AGREEMENT WITN THE CITY OF FAIRVIEW PARK WHEREIN THE <br />CITY OF NORTH OLMSTED IS TO SERVE AS LEAD AGENCY IN AN APPLICATION <br />FOR A GRANT TO ASSIST IN THE DESIGN AND CONSTRUCTION OF SANITARY <br />SEWER SYSTEM IMPROVEMENTS AND REHABILITATION RECOMMENDED IN THE <br />FACILITY PLAN STEP 1 SEWER SYSTE14 EVALUATION SURVEY (SSES) REPORT <br />AND TO CONSTRUCT IMPROVEMEfJTS TO THE NORTH OLMSTED WASTEWATER <br />TREATMENT PLANT AS DESIGNED ACCORDING TO THE FACILITY PLAN STEP 2 <br />GRANT AND TO PERFORM OTHER NECESSARY MATTERS FOR A STEP 3 FEDERAL <br />GRANT UNDER THE PROVISIONS OF THE CLEAN WATER ACT AMMENDMENTS OF <br />1977 AS PAP.T OF THE AREA KNOWN AS THE NORTH OLMSTED FACILITY PLAN, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, the City of North Olmsted has completed a Step 1 Facilitv Plan, <br />Sewer System Evaluation Survey, and the Step 2 design of improvements <br />to the IVorth Olmsted lrlastewater Treatment Plant for wastewater collection and <br />treatment in the North Olmsted Facility Planning Area, and <br />WHEREAS, sections of incorporated areas in the City of Fairview Park <br />are tributary to and served by the municipal sewer systems in the City of North <br />Olmsted, and <br />WHEREAS, the City of North Olmsted desires a sharing of costs for the <br />construction of improvements to the North Olmsted Wastewater Treatment Plant, <br />and <br />WHEREAS, the City of North Olmsted and the City of Fairview Park desire <br />to improve the sanitary sewer collection system as recommended in the Sewer <br />System Evaluation Survey report, and <br />IJHEREAS, the United States Environmental Protection Agency requires an <br />agreement between the City of North Olmsted and the City of Fairview Park <br />incorporating a user rate methodology and sewer use regulations. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the P•1ayor be and he is hereby directed to enter into <br />an agreement with the City of Fairview Park to apply for a grant to share in <br />the local costs for design and construction of improvements to the sanitary <br />sewer system and the North Olmsted Wastewater Treatment Plant, the construction <br />of improvements to the North Olmsted Wastewater Treatment Plant, a sanitary sewer <br />user charge methodology and sewer use regulations. <br />SECTION 2: That this ordinance is hereby declared to be an emergency <br />measure necessary for the preservation of the public health, safety and welfare, <br />and for the further reason that it is imnediately necessary in order to expedite <br />the filing of the application for federal grants, and further provided it <br />receives the affirmative vote of two-thirds of all members elected to Council, <br />it shall take effect and be in force immediately upon its passage and approval <br />by the Mayor. <br />PASSED: <br />ka.A4 <br />ATTEST: <br />?. ? <br />Florence E.
