<br />the follovrinR described lands, of which said grantor(s) warrant they are the Owners
<br />in fee simPle, situated in the City of North Olmsted, County of Cuyahoga and State
<br />of Ohio, and identified by Permanent Parcel'No. 232-13-12
<br />said Frer?ises having been acquired by deed dated March. 1983 ?
<br />and recorded in Volume 51 Page 433 ?
<br />of the Cuyahoga County Record of Deeds. .
<br />The easement is described as follows:
<br />Situated in the. City of North Olmsted, County of Cuyahoga and State of Ohio and being
<br />known as part of Original Olmsted Township Lot. No. 21 in Tract No. 6 and being bounded
<br />and described a-s follows:
<br />Beginning at tNe Northeasterly corner of land conveyed to John W. Heller and Captola
<br />Heller by deed recorded in Volume 5816, Page 201 of Cuyahoga County Deed Records said
<br />point-being in the centerline of Dover Center Road distant South 6° 21' 52" East 207.31
<br />feet f rom its intersection with the centerline of Mill Road; Thence, North 790 36' 21"
<br />West 121.00 feet along the Southerly line of land conveyed to John Neubauer and Mary
<br />Newbauer by deed recorded in Volume 1670, Page 618 of Cuyahoga County Deed Records
<br />to the Southwesterly corner therein; Thence, South 89° 53' 20" West 27.05 feet along
<br />a Northerly line of land so conveyed to John W. Heller and Captola Heller to the
<br />Northwesterly corner therein; Thence, South 89° 38' 8" West 26.24 feet along the
<br />Northerly line of land conveyed to John W. Heller and Captola Heller by deed recorded
<br />in Volume 7075, Page 408 of Cuyahoga County Deed Records to the Northwesterly corner
<br />therein; Thence, South 0° 21' 52" East 15.00 feet along the Westerly line of land
<br />conveyed to John W. Heller and Captola Heller in Volume 7075, Page 408; Thence, South
<br />82° 51' 3" East 173.65 feet to a point in the center line of Dover Center Road; Thence,
<br />North 0° Zl' 52" West 15.00 along the center line of Dover Center Road to the place of
<br />beginning, according to a survey by Alex Kanareff & Associates dated June 21,1983.
<br />The above easement is granted for the purpose of constructing, maintaining and
<br />operating a storm drain, together with the necessary manholes, for the transportation
<br />of surface water with the right of unimpaired access to said storm drain the rights
<br />of ingress and egress, on, over and through said land for all purposes necessary and
<br />incident to the construction, operation and maintenance and from time, to time, alter,
<br />repair, or remove the same.
<br />The Grantor(s) herein reserve the right to fully use and enjoy said premises
<br />for all purposes consistent with the full use and enjoyment by the grantee of the
<br />easement herein granted. The construction of structures as defined in the Grantees
<br />Building Code, except nublic utilities, is prohibited directly over the stom drain.
<br />Grantee shall have the right to change the size of its storm drain, the damages,
<br />.if any, in making such change to be paid by the grantee.
<br />After the storm drain is constructed in the above described premises, the
<br />grantee agrees to return the surface of the ground to its original elevation.
<br />. The rights herein granted may be assipned in whole or in part, and the terms,
<br />.conditions and vrovisions thereof shall extend to and be binding upon the heirs,
<br />executors, administrators, personal representatives, successors and assigns, of the
<br />parties hereto.
