° „rr ' . . <br />' CITY OF PJORTH OLMSTED <br />ORDINANCE N0. 84 - 11 <br />PAGE 3 <br />SECTION 10: Grades on Dedicated Streets within the City of North <br />Olmsted <br />That, on a dedicated street within the City of North Olmsted, no <br />person, firm or corporation shall be issued a Building Permit for the <br />construction of any structure until a$500.00 cash deposit is paid to <br />the Engineering Department to cover administrative costs, costs for <br />checking grades and drainage and surface water. The balance of said <br />cash deposit shall be refunded upon compliance with the terms of this <br />ordinance, after deducting therefrom any costs and expenses incurred <br />by the City as a result of work done by the City Engineer, Assistant Cit,y <br />Engineer, or the Engineering Department field crew. <br />The following are Engineering inspection and grading deposits for <br />commercial (including multi-family housing) developments: <br />Less than 1 acre . . . . . . . . . . . . . . . . . . $1 , 500 <br />1 to 3 acres . . . . . . . . . . . . . . . . . . . . $2,500 <br />3 to 5 acres . . . . . . . . . . . . . . . . . . . . $4,000 <br />Over 5 acres . . . . . . . . . . . . . . . . . . . . $6,000 <br />When Engineering Department time charges have reduced the account <br />balance below 50% of the above listed amounts, the developer shall, <br />upon notification, deposit the additional amount necessary to restore <br />the balance to the amount required. <br />If the aforesaid work is not done within thirty (30) days from <br />the time of the sending of written notice by the City of North Olmsted, <br />the City may do the work, and the aforesaid cash deposit shall be <br />applied to the cost of the City doina the aforesaid grading. Any funds <br />which are in excess of the City's cost of grading shall be returned to <br />the individual making the deposit as aforesaid; and further, any defi- <br />ciency in funds between the deposit and the cost of the City doing the <br />grading, shall become a lien upon the lands and shall be certified to <br />the Auditor of Cuyahoga County for entering upon th.e tax duplicate and <br />collection as other taxes and shall be returned by the Auditor of <br />Cuyahoga County to the City for deposit in the General Fund of the City <br />of North Olmsted. <br />SECTION 11: Grades Where no Grade Plan Provided. <br />When the City Engineer is not provided a grade plan for approval, <br />the City Engineer shall be charged with the duty of checking all natural <br />and finished grade lines of all lots, plots, or lands located within the <br />municipal boundaries of the City of North Olmsted and shall establish <br />grade lines for all streets, sidewalks, sanitary and storm sewers and <br />structures of every kind and description. <br />SECTION 12: <br />Maintaining Grade Lines Established by the City. <br />When the City Engineer has set and finally determined and <br />established the finished grade line of any qarcel of real estate, lot, <br />or land within the City of North Olmsted, Ohio, thus providing for the <br />drainage of surface water therefrom, the owner, occupant, or any other <br />person in charge of said premises shall continue to maintain and adhere <br />to said finished grade line of said premises and shall further keep all <br />drains, ditches, stvales, or other surface water conductors open and free <br />and clear of any and all obstructions. <br />Any builder, contractor, landscaper, or owner doing any grading, <br />regrading, landscaping, sodding, or performing any other work affecting <br />drainage of any parcel of land in the City of North Olmsted, Ohio, shall, <br />prior to doing any such work, obtain from the City Engineer a Landscaping <br />Permit to perform such work. Such person or persons shall furnish a plan <br />of the parcel of land upon which the work is to be performed. The plan <br />shall show all data necessary to determine the extent and character of <br />the work to be done and its effect upon drainage.
