? <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 84-2 <br />BY: RUSS BIERMAN <br />AN ORDINANCE VACATING NORTH OLMSTED COURT LOCATED <br />IN THE CITY OF NORTH OLMSTED, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, North Olmsted Court was dedicated for public <br />use on April 4, 1906, in order to give access to the North Olmsted <br />Town Hall from Lorain Road, and <br />WIiEREAS, since the building of the new municipal complex, <br />the same is no longer needed as a dedicated roadway, and would <br />be better suited as an internal drive servicing the various <br />buildings within the City Hall Complex, and <br />WHEREAS, it has been determined by this Council that said <br />roadway is no longer suitable for public use, and <br />WHEREAS, pursuant to Ohio Revised Code Section 723.05, <br />Council may, on its own authority, for good cause shown, vacate <br />any street or portion thereof, and <br />WHEREAS, the Planning Commission on the ?_?ay of <br />, 1984, approved the vacating of North <br />Ol te Cou as a oresaid, finding that it no longer was needed <br />f street purposes, and <br />WHEREAS, Council, upon hearing, is satisfied there is <br />cause for such vacation, and that it will not be detrimental to <br />the general interest and ought to be made. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE <br />CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That North Olmsted Court, be and the same is <br />hereby vacate3 as is more fully set out on the vacation plat <br />which is on file in the Office of the City Engineer, which is <br />made a part hereof. <br />SECTION 2: That this Ordinance is hereby declared to be <br />an emergency measure, immediately necessary for the preservation <br />of the public health, safety and welfare, and for the further <br />reason that it is immediately necessary to control the internal <br />traffic at the City Hall Complex by eliminating vehicles traveling <br />through from Lorain Road to Dover Center Road, thereby causing danger <br />to both pedestrians and vehicular traffic within the City Hall <br />Complex, and further provided it receives the affirmative vote of <br />two thirds of all members of Council, it shall take effect arid be <br />in force immediately upon its passage and approval by the Mayor. <br />PASSED: 44,. __- A If / o s't/ <br />ATTEST: <br />F`LOR NCE C PBELL, (ZKERK OF COUNC L -..AMh6D:-B,0 ?
