•' k• t • , ? ? ? <br />City shall have the right to copy the Dis- <br />charger's records relevant to determining compli- <br />ance with the requirements of the Codified Ordin- <br />ances. Results of sampling, inspection, monitor- <br />ing, and metering done by the City will be avail- <br />able to the Discharger. <br />(v) Confidential Information. Information and data <br />furnisheci to the City with respect to the nature <br />and frequency of discharge shall be available to <br />the public or other government agency without <br />restriction unless the Discharger specifically <br />requests and is able to demonstrate to the satis- <br />faction of the City that the release of such <br />information would divulge information, processes <br />or methocis of production entitled to protection <br />as trade secrets or proprietary information of <br />the Discharger. When requested by a Discharger <br />furnishing a report, the portions of a report <br />which may disclose tra8e secrets or secret pro- <br />cesses shall not be made.available for inspection <br />by the public but shall be made available upon <br />written request to governmental agencies for use <br />related to this Ordinance, the National Pollutant <br />Discharge Elimination System (NPDES) Permit, <br />State Disposal System Permit, the Pretreatment <br />Programs, or all of these, provided however, that <br />such portions of a report shall be available for <br />use by the state or any state agency in judicial <br />review or enforcement proceedings involving the <br />Discharger furnishing the report. Wastewater <br />constituents and characteristics will not be <br />recognized as confidential information. Informa- <br />tion accepted by the City as confidential shall <br />not be transmitted to any party except as pro- <br />vicied herein and unless a ten-day notification is <br />given to the Discharger. <br />917.06 ENFORCENIENT. <br />(a) No Discharger shall violate any provision, regulation or <br />requirement of the Cociified Ordinances. <br />(b) Whenever the Service Director finds a Discharger in violation <br />of the Codified Ordinances, he may serve written notice upon the <br />violator stating a brief and concise description of the violation and <br />direct compliance with the Codified Ordinances within 10 days. <br />Service of the notice shall be made personally or by certified <br />mail upon the Discharger or Authorized Representative of the Indus- <br />trial User. <br />-11-
