WILAMOSKY <br />AN ORDINANCE AUTHORIZING THE CITY TO "PICK-UP" <br />EDIPLJYEE CONTRIBUTIONS TO THF OHIO ?'UBLIC <br />EMPLOYEES RETIREMFNT SYSTEM (pERS), AS AMFNDF.D. <br />BE IT ORDAINFD BY THE COUr1CIL OF THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION 1: That the contribution ri <br />City emn oyee escribed belota to the Ohio <br />System (pERS) as an employee contribution <br />Section 145.47, shall be paid by the City <br />in lieu of contributions by the employees <br />visions of this Ordinance. <br />/ <br />I <br />9L ) <br />?auired to be made by each <br />Public Fmnloyees Retirement <br />under Ohio Revised Code, <br />on behalf o_f those employees <br />in accordance with the pro- <br />SECTION 2: That the total compensation payable by the City to <br />each employee in any pay period shall be reduced by the amount nay- <br />able by the City to PERS on behalf of that employee under Section 1 <br />of this Ordinance. <br />SECTION 3: That the provisions of this Ordinance shall anply to <br />all employees required to make employee contributions to pERS under Ohio <br />Revised Code Section 145.47 and no employee sha11 have the ontion to <br />receive direct payment of the amounts contributed by the City to PERS <br />on his or her behalf instead of having them contributed to pERS. <br />SFCTION 4: That the h4ayor and Finance Director are hereby <br />authorizeccan 7irected to take any and all acts whichare necessary <br />and appropriate to initiate implementation of the nrovisions of this <br />Ordinance, including, but not limited to, making applications to the. <br />Internal ?2evenue Service for private letter rulings concerning Federal <br />tax treatment of the PERS pick-un plan and making reauired applications <br />to the PERS Board of Trustees. <br />SF.CTION 5: That subject to any requirements imnosed by the Inter- <br />nal Revenue Service and the PERS board, the provisions of this Ordinance <br />shall apply to all payroll payments payable by the City of North Olmsted, <br />to employees, after January 1, 1985, and if not administratively imple- <br />mented by January 1, 1985, said nayments shall be made effective <br />retroactive to January 1, 1985. <br />SECTION 6: That this Ordinance shall apply to the following class <br />of employees an pulblic officials: All employees, both hourly and <br />salaried, in the various divisions of the Department of Public Service; <br />non-sworn employees of the Department of Public Safety; employees of the <br />Recreation Center and the Recreation Department; employees of the Senior <br />Center and the Department of Human Resources; the Mayor, the Director of <br />Law; the Director of Finance and their respective employees.
