..-? ?..._......._. <br />._ _.._..?. .:_,?.?__.. <br />? <br />? .? <br />?,?.,. ,....? <br />? <br />A G R E E M E N T <br />THIS AGREEMENT, entered into as of the 3ey day of July, <br />1984, between and among the City of North Olmstegtd, Cuyahoga <br />County, Ohio, a municipal corporation organized pnd existing <br />. <br />under the Constitution and laws of the State oi Ohio (the <br />"Issuer"), and Fogg-North Olmstead, Ltd., an Ohio Limited <br />Partnership, its successors, nominees and assigns (the <br />"Borrower" ) in furtherance of the public purposes of Section 13 <br />of Article VIII of the Ohio Constitution to create or preserve <br />jobs and employme nt opportunities and to improve the economgc <br />- welfare of the people of the State of Ohio; <br />WHEREAS, Borrower desires to acquire, construct, improve, <br />install and equip within the boundaries of the Issue r, real and <br />personal property comprising an addition to a comme rcial <br />facility, located within the boundaries of the Issuer to be <br />owned by Borrower and leased to Bryant & Stratton, which is <br />e ngaged in training students for various business career pro- <br />grams and for related purposes (the "Project"), the cost of <br />which Project is now estimated not to exceed $420,000, and, <br />which Project will provide additional jobs and employme nt <br />opportunities within the City of North Olmstead and increase the <br />economic welfare of the State of Ohio and the Issuer; and <br />WHEREAS, Borrower has evidenced a desire to finance such <br />acquisition, construction, improveme nt, installation and equip- <br />ping from the proceeds of Industrial DeveloQme nt First Mortyaye <br />Revenue Bonds issued pursuant to the authority of Article VIII, <br />Section 13 of the Ohio Constitution and Chapter 165 of the Ohio <br />Revised Code, in an aggregate principal amount now estimated not <br />to exceed $420,000 (the "Bonds"); and <br />-1-
