R <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 84- 62 <br />PAGE 2 <br />provided in Section 549.11. <br />(b) No person shall discharge, ignite or explode any <br />fireworks, as defined herein, within the Municipality, <br />except as provided in Section 549.11. <br />The term "fireworks" means any combustible or <br />explosive compositions, or any substance or combination <br />of substances or article prepared for the purpose of <br />producing a visible or an audible effect by combustion, <br />explosion, deflagration or detonation, but shall not <br />mean or include toy pistols, toy canes, toy guns or <br />other devices in which paper or plastic caps containing <br />twenty-five hundredths grains or less of explosive <br />compound are used, provided they are so constructed that <br />the hand cannot come in contact with the cap when in <br />place for the explosion, and toy pistol paper or plastic <br />caps which contain twenty hundredths grains or less of <br />explosive mixture. (ORC 3743.27, 3743.32) <br />(c) The enforcement of the provisions of this chapter <br />shall be the duty and the responsibility of the Division <br />of Fire and of the Division of Police. The regular, <br />full-time members of the Division of Fire are hereby <br />clothed with the necessary police power to enable them <br />to issue citations for violations of the provisions of <br />this chapter and to otherwise enforce the provisions of <br />this chapter. <br />(d) Whoever violates section (a) is guilty of a <br />misdemeanor of the third degree. <br />(e) Whoever violates section (b) is guilty of a minor <br />disdemeanor. <br />SECTION 2: That any Ordinance or parts of Ordinances <br />inconsistent herewith are hereby repealed. <br />SECTION 3: That this Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of <br />the public health, safety and welfare and for the further reason <br />that this Council desires to control the use of fireworks during <br />the 1984 season, and further provided it receives the affirmative <br />vote of two-third of all members elected to Council, it shall <br />take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />PASSED: Q ( ?
