BIERMAN CITY OF NORTH OLMSTED ORDINANCE N0. 84- 67 AN ORDINANCE AMENDING SECTION 1174.06 OF THE ZUNING CODE, ENTITLED "REAR YARD RESTRICTIONS" OF CHAPTER 1174 ENTITLED "HEIGHT AND AREA REGULATIONS FOR RETAIL BUSINESS DISTRICTS" AS AMENDED. WHEREAS, this Council has recently enacted Ordinance No. 83- 137, which amended Section 1174.06 of the Zoning Code; and WHEREAS, in so doing, this Council inadvertently deleted a paragraph in Section 1174.06, as amended, which provided generally for "Rear Year Restrictions" in general retail business districts; and WHEREAS, it is the desire of this Council to correct said Section 1174.06 by reinserting the language which was deleted in the enactment of Ordinance No. 83-137. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That Section 1174.06 of the Zoning Code entitled "Rear Yard Restriction" of Chapter 1174 entitled "Height and Area Regulations for Retail Business Districts", which now reads: "In the event the rear yard of any property located in a general Retail Business District abuts any street, including a limited access highway, but excluding interstate highways, a rear yard of at least fifty (50) feet from that street shall be maintained, in addition to the fifty (50) feet front set back requirements of Section 1174.02 of this Code. No structure shall be maintained, goods sold, merchandise displayed, nor business activity conducted within the aforesaid rear year area. Such rear yeard may be used for parking purposes only and shall not be used for the storage of automobiles or other vehicular equipment." Be and the same is hereby amended and as amended shall read as follows: Section 1174,06 Rear Yard Restrictions "In any Retail Business District, a rear yard of at least twenty (20) feet in depth shall be provided in the event the building is used either in whole or in part as a dwelling.
