r <br />w <br />'aww' <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO.: 84-82 <br />tq 4q <br />14,.,1 <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELECTORS <br />OF TIiE CITY OF NORTH OLMSTED OF AN AMENDMENT TO SECTION 8 <br />OF ARTICLE VIII OF THE CHARTER OF THE CITY OF NORTH OLMSTED <br />TO PERMIT THIS COUNCIL TO LEVY ANNUALLY, WITHOUT A VOTE OF <br />THE PEOPLE, AN ADDITIONAL TAX AT A RATE NOT E%CEEDING 2.6 <br />MILLS TO PAY ANNUAL DEBT SERVICE REQUIREMENTS ON CERTAIN <br />OBLIGATIONS INITIALLY INCURRED ON OR AFTER JANUARY 1, 1976 <br />AND PRIOR TO JANUARY 1, 1987 TO PAY COSTS OF IMPROVING THE <br />M[1NICIPAL SANITARY SEWERAGE SYSTEM, AND DECLARING AN <br />EMERGENCY. <br />BE IT ORDAINED by the Council of the City of North Olmsted, Cuyahoga <br />County, Ohio, two-thirds of all members concurring: <br />SECTION 1. That pursuant to Article XVIII, Section 9 of the Ohio <br />Constitution and Article XII of the Charter of the City of North Olmsted, this <br />Council hereby authorizes and directs the submission to the electors of the <br />City of North Olmsted at an election to be held at the usual places of voting <br />in said City on Tuesday, November 6, 1984, the following proposal to amend the <br />Charter of the City of North Olmsted: <br />That existing Section 8 of Article VIII of the Charter be amended to <br />read as follows: <br />"SECTION 8: LIMITATION ON THE RATE OF TAXATION <br />(a) The aggregate amount of taxes that may be levied by the <br />Council without a vote of the people on taxable property assessed and <br />listed for taxation according to value shall not exceed in any one <br />year the aggregate of the amonnts provided for in Paragraphs (b), (c) <br />and (d) of this Section 8, and all such taxes shall be levied by not <br />less than a two-thirds affirmative vote of the members of Council <br />eligible to vote. <br />(b) Except as provided in Paragraphs (c) and (d) of this <br />Section 8, for all purposes of the municipalitq the Council may, <br />without a vote of the people, levy annually not more than eleven and <br />one-tenth (11.1) mills for each dollar of assessed valuation. Of <br />said levy, an amount shall annually be levied sufficient to pay the <br />interest, sinking fund and retirement charges on all general obliga- <br />tion bonds and general obligation bond anticipation notes of the <br />municipality heretofore or hereafter authorized to be issued without <br />a vote of the electors, except to the extent Council determines that <br />such levy for certain bonds or notes issued for improvements to the <br />municipal sanitary sewerage system should be made pursuant to the <br />provisions of Paragraphs (c) and (d) of this Section 8, which levy <br />under this Paragraph (b) shall be placed before and in preference to <br />all other levies and for the full amount thereof. Of the remaining <br />portion of said levy, an amount shall be levied annually sufficient <br />to provide the amounts required by law for police pensions (.3 mill) <br />and firemen's pensions (.3 mill); an amount shall be levied annuallq <br />for the purpose of paying the expense of recreation and providing <br />recreational facilities (.5 mill), and the balance thereof may <br />annually be levied for the purpose of paying the current operating <br />expenses of the municipality.
