CITY OF NORTH OLMSTED ORDINANCE N0. 84-96 BY: Mr. Bierman AN ORDINANCE REQUIRING ANY PERSON CONVICTED OF AN OFFENSE, OTHER THAN A MINOR MISDEAMEANOR AND CONFINED TO PRISON, STATION HOUSE, WORKHOUSE OR COUNTY JAIL TO REIMBURSE THE CITY OF NORTH OLMSTED FOR ITS EXPENSES INCURRED BY REASON OF CONFINEMENT AND AUTHORIZING THE LAW DEPARTMENT TO INSTITUTE AN APPROPRIATE CIVIL ACTION TO RECOVER SAME, AND DECLARING AN EMERGENCY, WHEREAS, the Ohio General Assembly has enacted Am. Sub. H.B. 363 into law; and WHEREAS, said House Bill shall become effective September 26, 1984; and WHEREAS, said House Bill authorizes the Council, of a Municipal Corporation, to require any person who was convicted of an offense other than a minor misdemeanor to reimburse the City for the expenses incurred by the Municipal Corporation by reason of such confinement, including but not limited to expenses relating to the provision of food, clothing and shelter; and WHEREAS, reimbursement may, pursuant to the provisions of Am. Sub. H.B. 363, be required if confinement is in a workhouse, prison, station house or county jail; and NOtid, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUTNY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That any person convicted of any offense other than a minor misdeameanor and who is thereafter confined to a workhouse, prison, station house or county jail shall reimburse to the City of North Olmsted its expenses incurred by reason of said confinement, including but not limited to, the provision of food, clothing, and shelter. The amount of reimbursement shall be determined by a court of competent jurisdiction in an amount and manner provided by law. SECTION 2: That the Law Department is hereby authorized and directed to institute an appropriate civil action in the name of the City in a Court of competent jurisdiction to recover from the convict reimbursement for the expenses of confinement in a workhouse, prison, station house or county jail, as may be determined by the Court in accordance with law. SECTION 3: That all amounts recovered for reimbursement of expenses of confinement shall be paid into the General Fund of the City. SECTION 4: That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of public peace, health, safety and welfare, and for the further reason that it provides for the daily operation of a municipal department, and provided it receives the affirmative vote of two- thirds of all members elected to Council, it shall take effect immediately upon its passage and approval by the Mayor.
