RADEMAKER <br />AN ORDINANCE CREATING NEW AND REVISED CHAPTER <br />950 OF THE NORTH OLMSTED CODIFIED ORDINANCES <br />ENTITLED "URBAN FOREST ORDINANCE," AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, this Council has become aware that some owners of commercial <br />lots within the City of North Olmsted have cut down many or all of the <br />trees on their lots prior to submitting development plans to the City under <br />the applicable provisions of the City's zoning code; and <br />WHEREAS, this Council recognizes that trees located on commercial lots <br />and multi-family residential lots which abut public roads and highways are <br />a natural resource of the City; and <br />WHEREAS, this Council further recognizes and believes that the <br />unregulated removal and planting of trees upon commercial lots and multi- <br />family residential lots affects real estate values in the City of North <br />Olmsted and is aesthetically harmful to residents, visitors, and the public <br />travelling along roads and highway within the City of North Olmsted; and <br />WHEREAS, it is the intent of this Council consistent with the concerns <br />herein expressed, to exercise this City's police powers to regulate the <br />removal and planting of trees in such areas, by the issuance and denial of <br />permits, so as to better, promote and protect the public health, safety and <br />welfare; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF NORTH OLMSTED, COUNTY OF <br />CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there be and hereby is created a new and revised <br />Chapter 950 of the North Olmsted Codified Ordinances, entitled °tUrban <br />Forest Ordinance," which shall read and provide as follows: <br />CHAPTER 950 <br />URBAN FOREST ORDINANCE <br />Section 950.01. Definitions. For purposes of this Chapter, the <br />following terms are defined as follows: <br />(a) "City" shall mean the City of North Olmsted, Ohio. <br />(b) "City Forester" shall be the qualified designated official of <br />1
