RADEMAKER AN ORDINANCE CREATING NEW AND REVISED CHAPTER 950 OF THE NORTH OLMSTED CODIFIED ORDINANCES ENTITLED "URBAN FOREST ORDINANCE," AND DECLARING AN EMERGENCY. WHEREAS, this Council has become aware that some owners of commercial lots within the City of North Olmsted have cut down many or all of the trees on their lots prior to submitting development plans to the City under the applicable provisions of the City's zoning code; and WHEREAS, this Council recognizes that trees located on commercial lots and multi-family residential lots which abut public roads and highways are a natural resource of the City; and WHEREAS, this Council further recognizes and believes that the unregulated removal and planting of trees upon commercial lots and multi- family residential lots affects real estate values in the City of North Olmsted and is aesthetically harmful to residents, visitors, and the public travelling along roads and highway within the City of North Olmsted; and WHEREAS, it is the intent of this Council consistent with the concerns herein expressed, to exercise this City's police powers to regulate the removal and planting of trees in such areas, by the issuance and denial of permits, so as to better, promote and protect the public health, safety and welfare; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That there be and hereby is created a new and revised Chapter 950 of the North Olmsted Codified Ordinances, entitled °tUrban Forest Ordinance," which shall read and provide as follows: CHAPTER 950 URBAN FOREST ORDINANCE Section 950.01. Definitions. For purposes of this Chapter, the following terms are defined as follows: (a) "City" shall mean the City of North Olmsted, Ohio.
