?ft <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 85 - 126 <br />BY: DENNIS RADEMAKER <br />AN ORDINANCE CREATING NEW CHAPTER 950 OF THE NORTH OLMSTED <br />CODIFIED ORDINANCES ENTITLED "URB.AN FOREST ORDINANCE", AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, this Council is desirous of protecting and promoting the <br />growth and health of trees in public places and treelawn areas within <br />the City of North Olmsted by enacting an Urban Forest Ordinance which <br />will empower the City Forester to regulate the planting and removing <br />of trees, and construction and excavation within close proximity of <br />trees; and <br />WHEREAS, passage of such an Ordinance will further qualify the <br />City of North Olmsted, upon timely application, for recognition by <br />the National Arbor Day Foundation as a TREE CITY USA; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That there be and hereby is created a new Chapter 950 <br />of the North Olmsted Codified Ordinances, entitled "Urban Forest <br />Ordinance," which shall read and provide as follows: <br />CHAPTER 950 <br />URBAN FOREST ORDINANCE <br />Section 950.01. Definitions. For purposes of this Chapter, the <br />following terms are defined as follows: <br />(a) "Person" is any person, firm, partnership, association, <br />corporation, company, organization of any kind, public or <br />private. <br />(b) "City" shall mean the City of North Olmsted, Ohio. <br />(c) "City Forester" shall be the qualified designated official <br />of the city assigned to carry out the execution of this <br />ordinance. <br />(d) "Street" means the entire width of every public way, ease- <br />ment, or right-of-way when any part thereof is open to <br />the use of the public as a matter of right, for purposes <br />of vehicular and pedestrian traffic. <br />(e) "Public Places" shall include all other grounds owned by or <br />under the control of the City of North Olmsted, Ohio. <br />(f) "Dripline" shall mean the approximately circular vertical <br />extension to the ground of the outermost branches and <br />leaves of the tree, as an indication of the spread of <br />the root system. <br />(g) "Treelawn" is that part of a street not covered by side- <br />walk or other paving, lying between the property line <br />and that portion of the street used for vehicular traffic, <br />usually the area between sidewalk and curb.
