. :. . .. . . . . .:..,H4.., r..-.. . . . . ... . . <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 85- 121 <br />BY: MAYOR ROBERT SWIETYNIOWSKI <br />AN ORDINANCE AUTHORIZING THE MAYOR ON BEHALF OF THE CITY <br />TO EXTEND THE EXISTING AGREEMENT WITH BFI FOR A ONE (1) <br />YEAR PERIOD FOR REFUSE PICKUP WITHIN THE CITY AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City heretofore has had a contract with BFI with respect <br />to the refuse service for the City of North Olmsted; and <br />WHEREAS, the specifications when bid three (3) years ago included a <br />provision that, on agreement of the parties the contract could be extended <br />on a yearly basis; and <br />WHEREAS, BFI has agreed with the City to extend the agreement for an <br />additional one (1) year period from January l, 1986, through December 31, <br />1986, at the same price per residential unit per month; and <br />WHEREAS, upon the recommendation of the Service Director and Mayor this <br />Council finds that it is in the best interest of the City to extend said <br />agreement. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That the Mayor be and he is hereby authorized and directed <br />to confirm the Council's desire to extend the current agreement with BFI <br />for refuse pickup within the City for an additional one (1) year period <br />from January l, 1986 through December 31, 1986. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, <br />safety and welfare, and for the further reason that it is immediately <br />necessary to ratify the extension of time so as to comply with the notice <br />reyuirements in the current contract, and further provided it receives the <br />affirmative vote of two-thirds of all members elected to Council it shall <br />take effect and be in force immediately upon its passage and approval by <br />the Mayor. <br />PASSED: &A„?
