00, CITY OF NORTH OLMSTED ORDINANCE N0. 85 - 116 B Y AN ORDINANCE ACCEPTING AN EASEMENT FOR THE INSTALLATION AND MAINTENANCE OF A WATER MAIN FOR THE PURPOSE OF SUPPLYING WATER SERVICE BY THE CITY OF CLEVELAND TO THE CHRIST THE KING COMMUNITY, AND DECLARING AN EMERGENCY. WHEREAS, Christ the King Community desires to extend water mains to service the Christ the King Community development, and WHEREAS, The City of Cleveland requires that extensions of water lines shall be approved only if easements are granted to both the City of Cleveland and the City of North Olmsted in order that water mains may be constructed and maintained therein, and WHEREAS, this Council deems it to be in the best interest of the City to accept the easement described herein: NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION l: That this Council does hereby accept an easement from Christ the King Community for the installation and maintenance of a water main for the purpose of supplying water service by the City of Cleveland into the Christ the King Community development, a copy of which said easement is attached hereto, and made a part hereof, as though fullyrewritten herein and marked "Exhibit A". SECTION 2: That the Director of Finance is hereby authorized to issue his warrant and pay to the Christ the King Community the sum of One Dollar ($1.00) and other valuable consideration for the granting of said easement. SECTION 3: That the Engineer of the City of North Olmsted is hereby directed to cause said easement to be recorded in the office of the Cuyahoga County Recorder. SECTION 4: That the Clerk of this Council is hereby authorized to forward a certified copy of this Ordinance to the Director of Public Utilities of the City of Cleveland. SECTION 5: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety, and welfare, and for the further reason that it is immediately necessary to install and maintain water service to the Christ the King Community, and further provided it receives the affir- mative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
