00, <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 85 - 116 <br />B Y <br />AN ORDINANCE ACCEPTING AN EASEMENT FOR THE INSTALLATION <br />AND MAINTENANCE OF A WATER MAIN FOR THE PURPOSE OF <br />SUPPLYING WATER SERVICE BY THE CITY OF CLEVELAND TO THE <br />CHRIST THE KING COMMUNITY, AND DECLARING AN EMERGENCY. <br />WHEREAS, Christ the King Community desires to extend water mains <br />to service the Christ the King Community development, and <br />WHEREAS, The City of Cleveland requires that extensions of water <br />lines shall be approved only if easements are granted to both the City <br />of Cleveland and the City of North Olmsted in order that water mains <br />may be constructed and maintained therein, and <br />WHEREAS, this Council deems it to be in the best interest of the <br />City to accept the easement described herein: <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: That this Council does hereby accept an easement <br />from Christ the King Community for the installation and maintenance of <br />a water main for the purpose of supplying water service by the City of <br />Cleveland into the Christ the King Community development, a copy of <br />which said easement is attached hereto, and made a part hereof, as though <br />fullyrewritten herein and marked "Exhibit A". <br />SECTION 2: That the Director of Finance is hereby authorized to <br />issue his warrant and pay to the Christ the King Community the sum of <br />One Dollar ($1.00) and other valuable consideration for the granting <br />of said easement. <br />SECTION 3: That the Engineer of the City of North Olmsted is <br />hereby directed to cause said easement to be recorded in the office of <br />the Cuyahoga County Recorder. <br />SECTION 4: That the Clerk of this Council is hereby authorized <br />to forward a certified copy of this Ordinance to the Director of Public <br />Utilities of the City of Cleveland. <br />SECTION 5: That this Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the preservation of the <br />public health, safety, and welfare, and for the further reason that it <br />is immediately necessary to install and maintain water service to the <br />Christ the King Community, and further provided it receives the affir- <br />mative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its passage and approval <br />by the Mayor. <br />PASSED: <br />ATTEST: <br />lqem? <br />Florence E.
