?- CITY OF NORTH OLMSTED ORDINANCE N0. 85- 87 BY: NIAYOR SWIETYNIOWSKI AN ORDINANCE APPROVING A MEMORANDUM OF UNDERSTANDING WITH THE AMERICAN FEDER.ATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES IN THE PUBLIC WORKS DIVISION OF THE DEPARTMENT OF PUBLIC SERVICE OF THE CITY OF NORTH OLMSTED, AND REPEALING ORDINANCE N0. 83-147 ENACTED DECEMBER 6, 1983, AND DECLARING AN EMERGENCY, AS AMENDED. WHEREAS, the City has entered into a Memorandum of Understanding with the American Federation of State, County and Municipal Employees with respect to the compensation and other conditions of employment of certain employees in the Public Works Division of the Department of Public Service of the City of North Olmsted, said Memorandum being authorized by Ordinance No. 73-115 enacted September 18, 1973;Ordinance No. 75-198 enacted September 2, 1975; Ordinance No. 77-170 enacted October 18, 1977; and Ordinance No. 79-116 enacted October 2, 1979, and Ordinance No. 81-125 enacted November 4, 1981; and Ordinance No. 83-147 enacted December 6, 1983. IVHEREAS, pursuant to the provisions of the Memorandum of Understanding provided for and incorporated in Ordinance No. 83-147 discussions have been conducted by the representatives of the City and representatives of the American Federation of State, County and Mun- icipal Employees concerning revisions in and a renewal of the Memorandum of Understanding, and WHEREAS, understandings have been reached in the course of said discussions with respect to the compensation and other conditions of employment of the employees aforementioned. NOW, THERF,FORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION l: That the Memorandum of Understanding with the American Federation of State, County and Municipal Employees, attached hereto and made a part hereof as though fully rewritten herein, is here- by adopted, ratified and approved, and the Nlayor is hereby authorized an d directed to affix his signature thereto for and on behalf of the City of North Olmsted. SECTION 2: That all other ordinances or resolutions or parts of ordinances or resolutions inconsistent herewith to the provisions of this ordinance and especially Ordinance No. 83-147 enacted on December 6, 1983, are hereby repealedi with the effective date of this ordinance to the extent that they pertain to employees in the bargaining unit covered by the Memorandum of Understanding and are inconsistent with this ordinance including the Memorandum of Understand- ing attached hereto and made a part hereof. SECTION 3: That the Clerk of Council is hereby instructed to forward a copy of this ordinance to the Director of Public Service and to the Director of Finance in order that the Director of Finance can pay the compensation authorized by this ordinance and the Memorandum of Understanding attached hereto and made a part hereof. SECTION 4: That this ordinance is hereby declared to be an emergency measure necessary for the preservation of the public peace, health and safety, and for the further reason that it is immediately necessary to adjust the reauirements of the various jobs, and futher provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be inforce immediately upon its passage and approval by the Nlayor.
