Home Rule City. Therefore, it is the intent of the City and the <br />Union that this Memorandum comply in every respect with applicable <br />legal statutes and charter requirements, and if it is determined <br />that any provision of the Memorandum is in conflict with law, <br />that provision shall be null and void and shall not affect the <br />validity of the remaining paragraphs of this Memorandum. In the <br />event of an unlawful determination, the City and the Union shall <br />meet within thirty (30) days for the purpose of negotiating a <br />lawful alternative provision. <br />SUB-CONTRACTING <br />70. The City shall meet and confer with the Union prior to <br />sub-contracting out bargaining unit work, other than emergency <br />work. In the event a subcontract causes a lay off, the City <br />will make every reasonable attempt to provide an opportunity of <br />employment with the subcontractor for said laid off bargaining <br />unit employees. <br />LONGEVITY PAY <br />71. Employees in the bargaining unit having completed five (S) <br />years of full-time continuous service as employees of said <br />department, or having been transferred from some other department <br />by administrative appointment, shall be paid an additional three <br />percent (3%) of their base annual salary, thereafter until <br />completion of ten (10) years full-time continuous service; after <br />which such employees shall receive four percent (40) of their <br />-35- <br />.??
