? <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 85- 84 <br />BY : .t l??,l•,-. ,.i.o lZu1 <br />01- <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER INTO A <br />SUPPLEMENTAL AGREEMENT WITH THE CONSULTING FIRM OF <br />DALTON, DALTON, NEWPORT FOR THE DESIGN OF IMPROVEMENTS <br />TO THE NORTH OLMSTED WASTEWATER TREATMENT PLANT AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the City adopted Ordinance No. 80-95 authorizing the hirinb <br />of the services of Dalton, Dalton, Newport for the design of improvements <br />to the North Olmsted Wastewater Treatment Plant; and <br />WHEREAS, subsequent to that agreement there were certain design <br />changes which were required by the Enviromental Protection Agency, which <br />design changes were made by Dalton, Dalton, Newport and were not <br />contemplated in the original agreement; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor to <br />enter into a supplemental agreement for the services rendered in addition <br />to those contemplated in the original agreement. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That the Mayor be and he is hereby authorized to enter <br />into a supplemental agreement with the firm of Dalton, Dalton, Newport for <br />additional services over and above the authorized by Ordinance No. 80-95, <br />which additional services are in the amount of $75,384.00, of which the <br />City will be required to pay 25% and the additional 75% is covered by <br />grant. <br />SECTION 2: That this Ordinance is heTeby declared to be an emergency <br />measure necessary for the immediate preservation of the pub1iC health, <br />safety and welfare of the City, and for the further reason that it is <br />necessary to provide for continuity of services with the engineering firm <br />of Dalton, Dalton, Newport and further provided it receives the <br />affirmative vote of two-thirds (2/3) of all members elected to Council, it <br />shall take effect and be in force immediately upon its passage and approval <br />by the Mayor. <br />PASSED: <br />ATTEST: f3 <br />LORENCE CAMPBELL, C RK OF COUNCIL AMES BOEHMER,,PRESIDENT OF COUNCIL <br />A PROVEll: First Reading: <br />Second Reading: <br />C? .
