CITY OF NORTH OLMSTED <br />ORDINANCE N0. 85 - 58 <br />BY: Ron Wilamosky <br />AN ORDINANCE AUTHORIZING THE BUILDING COMMISSIONER <br />TO PROCEED WITH THE DEMOLITION OR REMOVAL OF THE <br />DETACHED GARAGE LOCATED AT 5803 STEARNS ROAD, IN <br />THE CITY OF NORTH OLMSTED, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, pursuant to the provisions of Ordinance No. 133.01 and <br />1331.99 of the Codified Ordinances of the City of North Olmsted, the <br />Building Commissioner has determined that the abandoned structure loCate.d <br />at 5803 Stearns Road, North Olmsted, Ohio, the record title holder being <br />John Bryant, is unsafe, dangerous to human life and hazardous to the <br />safety, health, and public welfare of the citizens of the City of North <br />Olmsted; and <br />WHEREAS, notice to repair, remove, or demolish said building was sent <br />via certified mail, return receipt requested to John Bryant on January 29, <br />1985 at 38236 Lorain Road, North Olmsted, Ohio, ordering said title holder <br />to repair, remove, or demolish said building and to commence such repair, <br />removal, or demolition within sixty (60) days of receipt of said notice; <br />and <br />WHEREAS, said record title holder, John Bryant failed to reverse the <br />Building Commissioner's order and also failed to further appeal the <br />decision of the Zoning Board of Appeals to a higher tribunal of competent <br />jurisdiction and this time has failed to comply with the order of the <br />Building Commission. <br />NOW, THEREFORE, BE IT ORllAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That Council deems it necessary to proceed with the <br />demolition and removal of the unsafe structure at 5803 Stearns Road, North <br />Olmsted, owned by John Bryant, whose mailing address is 38436 Lorain Road, <br />North Olmsted, Ohio, by reason of the fact that said structure has been <br />determined to be dangerous to human life and a hazard to the public safety, <br />health and welfare of the citizens of the City of North Olmsted, Ohio, and <br />that the cost of said demolition and removal be paid from the General Fund <br />of the City of North Olmsted and charged to the owner as a special <br />assessment or lien on such parcel of land and assessed and collected in the <br />manner or other assessments as provided by law. <br />SECTION 2: That the Clerk of Council be and she is hereby direct to <br />forward a copy of this Ordinance to John Bryant at 38436 Lorain Road, North <br />Olmsted, Ohio 44070. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, <br />safety and welfare, and for the further reasons that the dilapidated <br />condition of said structure is a serious hazard to the health, safety, and
