<br />INSTALLATION AND MAINTENANCE OF A WATER MAIN
<br />FOR THE PURPOSE OF SUPPLYING WATER SERVICE
<br />KNOW ALL MEN BY THESE PRESENTS That, 7515 CORPORATION, the Grantor herein, for valu-
<br />able consideration received and to be received to its full satisfaction does hereby
<br />give, grant, ba'rgain, and convey to the City of North Olmsted and to the City of
<br />Cleveland, municipal corporation of the State of Ohio, the Grantees herein, the
<br />perpetual right-of-way and easement, for the purpose hereinafter mentioned in the
<br />following described premises, to wit:
<br />Situated in the City of North Olmsted, State of Ohio, and known as being part
<br />of the Original Olmsted Township Lot No. 28, and being a strip of land 60 feet wide,
<br />the centerline of cahich is described as fallows:
<br />Beginning at the most southerly end of the centerline of Dawn Drive as shown on
<br />the plat of the Manning and Campbell Subdivision No. 8, as recorded in Volume 185,
<br />Pages 56 and 57 in Cuyahoga County riap Records;
<br />Thence continuing South 0° 53' 22" East, along the southerly prolongation of
<br />the said centerline, 107.01 feet to a point of curve;
<br />Thence Southeasterly, and east, along a curve of 60 feet radius, concave to the
<br />northeast 94.25 feet to a point of tangency;
<br />Thence North 89° 06' 38" East, 1297.03 feet to a point of curve;
<br />Thence Northeasterly and North along a curve of 60 feet radius, concave to the
<br />Northwest, 94.25 feet to a point of tangency;
<br />Thence North 0° 53' 22" West, 107.01 feet to the most Southerly point on the
<br />centerline of Hunter Drive, as shown by the recorded plat of the Manning and Campbell
<br />Subdivision No. 8, as aforesaid.
<br />In consideration of the mutual covenants herein contained, the Grantor hereby
<br />gives, grants and conveys unto said Grantees, the right and easement to enter upon
<br />said premises and to lay, install, repair, and maintain therein a water main and
<br />appurtenances, including the installing and maintaining of service connections and
<br />pipes, setting and maintaining all water meters, and the making of all repairs to
<br />mains, service meters, and all appurtenances connected therewith that in the opinion
<br />of the Grantees, their successors or assigns, may be necessary at any time, also to
<br />turn off the water of any service or main, or to do any other thing that may be nec-
<br />essary or advisable in the judgement of said Grantees, their successors or assigns,
<br />in order to maintain or operate said main, meters, connections, pipes and appurte-
<br />nances in accordance with the ordinances, rules, and regulations for the management
<br />and protection of said Grantees now in force or that may hereafter be adopted. Fur-
<br />ther, whenever maintenance or work of any kind is required hereunder, the Grantees,
<br />either jointly or separately, shall not be responsible for restoration of the prop-
<br />perty or its environs to its original topographical condition, and should also be
<br />held blameless for any damage occuring by reason of water leakage from water mains
<br />or appurtenances.
<br />The Grantor further, in consideration of the acceptance of the easement above
<br />mentioned, by the Grantees, does hereby agree to pay the entire cost of installing
<br />a water main and appurtenances within the above described easement, constructed in
<br />accordance with the provisions, rules, regulations, and requirements of the said
<br />Grantees, their successors or assigns. Said water main, valves, hydrants, and
<br />appurtenances shall upon completion and approval by the Grantees, their successors
<br />or assigns, become the property of the Grantee, City of North Olmsted, its successors
<br />or assigns. Said water main and appurtenances installed by the Grantor shall remain
