<br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 85- 39 <br />BY: Mrs. Saringer <br />AL <br />J <br />AN ORDINANCE AMENDING CHAPTER 549 OF THE GENERAL <br />OFFENSES CODE OF THE CITY OF NORTH OLMSTED, <br />ENTITLED "WEAPONS AND EXPLOSIVES," BY ADDING A NEW <br />SECTION 549.14, ENTITLED "SALE, POSSESSION AND USE <br />OF STUN GUNS," AND DECLARING AN EMERGENCY. <br />WHEREAS, certain electronic instruments commonly known as stun guns <br />are specifically designed to immobilize human beings for a substantial <br />period of time; and <br />WHEREAS, sufficient scientific data does not yet exist to determine <br />the immediate and/or post-use physiological effect of these instruments <br />on the human body; and <br />WHEREAS, in the hands of the general public, particularly those <br />engaged in criminal activity, the use of stun guns greatly increases the <br />probability of the commission of acts detrimental and injurious to the <br />person and/or property of the residents of this City; and <br />WHEREAS, the use of stun guns by unauthorized and untrained persons <br />constitutes a substantial threat to the health, safety, and welfare of the <br />general public; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Chapter 549 of the General Offenses Code of the City <br />of North Olmsted be and the same is hereby amended by adding a new Section <br />549.14, to read as follows: <br />549.14 SALE, POSSESSION AND USE OF STUN GUNS <br />(a) No person, firm or corporation shall, within the <br />City, sell, offer for sale or have in his or its <br />possession or custody, any stun gun. <br />(b) As used in this Section "stun gun" means any <br />electronic instrument, device or thing which produces <br />, <br />emits or discharges any current, pulse, volt or charge <br />of electricity, regardless of voltage, amperage, or <br />frequency, and which is designed or specifically adapted <br />to stun, daze, traumatize, incapacitate, or paralyze a <br />human being. <br />(c) This Section does not apply to law enforcement <br />officers acting within the scope of their duties. <br />(d) A violation of this Section shall constitute a <br />misdemeanor of the first degree. <br />SECTION 2: That this Ordinance is declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety, <br />and welfare, and for the further reasons as set forth in the preamble to
